63.2(17) License & Registration Procedures

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A renewal inspection was initiated on January 13, 2021 and concluded on January 14, 2021. The director was contacted by telephone to initiate the inspection. There were 52 children present and 8 direct staff. The inspector emailed the director a list of items required to complete the inspection. The Inspector reviewed three
children?s records, board officers records, and three staff records submitted by the facility to ensure documentation was complete.

Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the facility.

The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Violations:
Standard #: 63.2(17)-1721.1-A
Description: Based on review of Board Officers records, the applicant did not have a central registry check or sworn disclosure updated every 5 years.

Evidence:
1. Agent #1 had a search of a central registry dated 10/05/2015, and a sworn disclosure statement dated 10/01/2015. Both documents were completed more than 5 years ago.

Plan of Correction: The applicant will complete a central registry check and sworn disclosure form.

Standard #: 63.2(17)-1721.1-B-3
Description: Based on review of Board Officers records, the applicant did not authorize the center to obtain the child abuse and neglect registry search from any state in which the agent has resided in the preceding five years.

Evidence:
1. Agent #1 moved to Washington (Approximate date 9/2018) and the results of the child abuse and neglect registry search from that State were not requested.

Plan of Correction: The applicant will authorize the center to obtain the child abuse and neglect registry search from the state of Washington.

Standard #: 63.2(17)-1721.1-B-4
Description: Based on review of Board Officers records, the applicant did not authorize the center to obtain a copy of the results of a criminal history check and sex offender registry check from any state in which the agent has resided in the preceding five years by the deadline of December 31, 2020.

Evidence:
1. Agent #1 lived in Oregon (OR) and Washington (WA) within the last 5 years. The results of the sex offender registry check were not obtained from OR until January 8, 2021. The results of the criminal history record check and sex offender registry check were not obtained from WA.
2. Agent #2 and Agent #3 lived in Maryland(MD) within the last 5 years. The results of the sex offender registry check from MD for both Agent #2 and Agent #3 were not obtained until January 11, 2021.

Plan of Correction: The applicant will authorize the center to obtain a copy of the results of a criminal history record check from the state of Oregon and Washington.
