Technical Assistance:
Out-of-state background check requirements for staff discussed.

Comments:
This licensing inspection was conducted using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A renewal inspection was initiated on 01/11/2021 and concluded on 01/14/2021. The director was contacted by telephone to initiate the inspection. There were 57 children present and 9 staff. The inspector emailed the director a list of items required to complete the inspection. The inspector reviewed 4 children's records and 4 staff records submitted by the facility to ensure documentation was complete.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the facility.

The licensing inspector has reviewed with the director COVID-19 essential guidance for child care programs.

Violations:
Standard #: 22VAC40-185-270-A
Description: Based on observation, the center failed to ensure that areas of the center shall be maintained in a safe condition.

Evidence:
1. A stand-up fan was observed placed on a low toddler sized table in the toddler classroom.
a. This fan was within reach of children and is a toppling hazard.

Plan of Correction: The fan was removed from the class during inspection. The safety captain and management team will do periodic inspections to make sure the center is maintained in safe conditions and will correct any deficiencies immediately.

Description: Based on record review and interview, the center failed to obtain a copy of information from the central registry maintained pursuant to ? 63.2-1515 on any investigation of child abuse or neglect from any state the individual has resided in within the past five years.

Evidence:
1. The results of a central registry check from the State of New York are not on file for staff 1.
a. Staff 1 has a hire date of 05/08/2018 and indicated on her sworn statement she had resided in the State of New York within the past five years.
b. Staff 1 verbally stated she had resided in New York as recently as 2016.
2. Administrative staff confirmed that the results of a central registry check from the State of New York were not on file for staff 1.

Plan of Correction: The out-of-state central registry form was sent in on 01/19/2021: Management will ensure that all new hire paperwork is completed prior to the staff member beginning employment. Management will conduct frequent inspections of employee files to ensure that all paperwork is compliant. District Manager will periodically check.

Description: Based on record review and interview, the center failed obtain a copy of the results of a sex offender registry check from any state in which the applicant has resided in the preceding five years.

Evidence:
1. The results of a sex offender check, from the State of New York, were not obtained until 01/19/2021 for staff 1.
2. Administrative staff verified that the sex offender check from the State of New York was not obtained by 12/31/2020 as required by legislation effective July 1, 2020.

Plan of Correction: The out-of-state sex offender check was complete on 01/19/2021: Management will ensure that all new hire paperwork is completed prior to the staff member beginning employment. Management will conduct frequent inspections of employee files to ensure that all paperwork is compliant. District Manager will periodically check.
