63.2(17) License & Registration Procedures

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
A monitoring inspection was initiated on January 21, 2021 and concluded on January 26, 2021. The director was contacted by telephone to initiate the inspection. There were 50 children present and 11 staff. The inspector emailed the director a list of items required to complete the inspection. The Inspector reviewed 3 children?s records and 3 staff records submitted by the facility to ensure documentation was complete. Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the facility.
The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Violations:
Standard #: 63.2(17)-1721.1-B-4
Description: Based on record review and staff interviews, the licensee did not ensure any agent for a child day center obtained a copy of the results of a criminal history record information check, a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from any state in which the individual has resided in the preceding five years.

Evidence; Two out of three staff records reviewed were determined to have inadequate out of state background checks.
1) The record for staff #1 start date 10-29-2020, did not include results of a sex offender registry check for the state of North Carolina where they had lived within the last 5 years.

2) The record for staff # 2 start date 8-10-2020, did not include results of a sex offender registry check for the state of New Jersey where they had lived within the last 5 years.

Plan of Correction: 1) Processed and emailed sex offender registry check for state of North Carolina 1/25/21. Federal law each state gets 45 business days to process check. Corrected 2-28-21
2) Processed sex offender registry check for New Jersey 1/22/2021. Corrected 1/22/21
