Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A monitoring inspection was initiated on 12/02/2020 and completed on 01/22/2021 in response to a self-reported incident of inappropriate behavior guidance. Based on the information gathered, which included staff interviews, record review and a review of center video, this self-reported incident is found to be valid.

Violations were found in the areas of operational responsibilities and behavior guidance. These violations are listed on the violation notice issued to the facility and were reviewed with the program director at the exit interview.

Violations:
Standard #: 22VAC40-185-40-E
Description: Based on interview, review of center video and written policies, the center failed to ensure that the operational responsibilities of the licensee shall include, but not be limited to, ensuring that the center's activities, services, and facilities are maintained in compliance with the center's own policies and procedures that are required by these standards.

Evidence:
1. The center positive guidance and redirection policy states: ?Always interact at the child?s level and do not attempt to lift/carry the child unless in immediate danger."
a. Center video shows staff 1 pulling child 1 by the lower part of his arm, out of the dramatic play area, after child 1 pushed another child down.
2. Staff 2 stated that staff 1 did not follow center policy when she pulled child 1 by the arm in order to remove him from the dramatic play area.

Plan of Correction: Staff member was retrained on appropriate positive guidance and redirection, lifting, and conflict resolution with children on 12/1/2020. Management will be doing periodic inspections to observe positive guidance in the classroom. DM will also periodically observe through observation.

Standard #: 22VAC40-185-400-B
Description: Based on staff interviews and review of video footage the facility failed to ensure that behavioral guidance shall be constructive in nature, age and stage appropriate, and shall be intended to redirect children to appropriate behavior and resolve conflicts.

Evidence:
1. At approximately 10:15 am on 12/01/2020 child 1 pushed child 2 while playing in the dramatic play area of the three-year old classroom.
a. Video footage shows staff 1 sitting at a table engaged in an activity with a child. Staff 1 stands up quickly and walks at a fast pace toward the dramatic play area and using a quick and continuous movement - leans down and pulls child 1, age three, by the lower part of his arm out of this area.
b. Video footage then shows staff 1 pull child 1 by the lower part of his arm, approximately three feet, from the dramatic play area.

Plan of Correction: Staff member was retrained on appropriate positive guidance and redirection during times of conflict amongst peers on 12/1/2020. Management will be doing periodic inspections to observe positive guidance in the classroom. DM will also periodically observe through observation.
