Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A complaint inspection was initiated on 12/3/20 and concluded on 2/12/21. An initial complaint was received by the department on 11/4/20 regarding allegations in the areas of physical plant, ratios, and medication administration. Additional complaints were also received by the department during the course of the investigation regarding allegations in the areas of COVID-19 guidance and mandates, supervision, playground procedures and sick child procedures. The center owner was contacted by telephone to conduct the investigation. Interviews with staff were conducted by telephone and documentation and records related the complaint were reviewed. A virtual walkthrough of the entire center was also conducted. Based on information gathered during the investigation, the portion of the complaint regarding COVID-19 guidance and mandates is determined to be valid and a violation was issued in the area of staffing and supervision.

Description: Based on interview, it was determined that while staff are supervising children the center did not ensure the care and protection of children.

Evidence:
Pursuant to the Governor?s Executive Order 72 and Order of Public Health Emergency 9, all children ages five and older and all staff are required to wear face coverings at child care programs while indoors and when outdoors and unable to maintain at least six feet of social distance. Additionally, the Virginia Department of Labor and Industry's temporary standard (effective 9/25/20) requires staff in child care settings to wear cloth face coverings.
1. During a complaint inspection on 12/3/20, staff 1 stated that all center staff did not start wearing cloth face coverings until 11/13/20. Staff 1 stated prior to that day, only some staff were wearing cloth face coverings while working in the center.

Plan of Correction: The center responded with the following: As of 11/13/20 all staff and adults entering or working at Le Bon Enfants are wearing masks full time. I did not realize that although we are a private facility, we/Le Bon Enfants staff were required to wear masks as part of the statewide mandate. This violation has been corrected and adhered to.
