63.2(17) License & Registration Procedures

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

An investigation in response to a self-reported incident was initiated on February 3, 2021 and concluded on February 4, 2021. The report received by the department was regarding a child being fed food that contained a known allergen. The director was contacted by telephone to conduct the investigation. The inspector emailed the director a list of documentation required to complete the investigation.

The evidence gathered during the investigation supported the self-report of non-compliance with standards or law and violations were issued. Any violations not related to the self report but identified during the course of the investigation can be found on the violation notice.

Violations:
Standard #: 22VAC40-185-340-A
Description: Based on staff interviews and review of documentation, staff did not ensure the care and protection of a child with a documented food allergy when a child was served food that contains a known allergen.

Evidence:
1. According to an allergy health care plan and classroom allergy list, Child #1(Age 15 months) has a documented food allergy to eggs with an allergy health care plan and emergency medication on site.
2. On 01/28/2021, Staff #1 and Staff #2 gave Child #1 a cupcake that contained egg.
3. After Child #1 ate the entire cupcake, Staff #1 observed Child #1 "gagging". Child #1 then started to spit and threw up. Child #1 cried, the left side of their face turned red, and began "itching" their eyes. Staff #1 called Staff #3 and Staff #4 and explained that Child #1 ate a cupcake and threw up. Staff #4 administered the epinephrine to Child #1 and Staff #3 called 911. Child #1 was transported to the local hospital accompanied by Staff #3. Staff #3 reported that at the hospital, Child #1 was administered a steroid and Diphenhydramine(Benedryl).
4. Staff #1 stated, "I knew [Child #1] had an egg allergy. I thought if the egg was cooked, [Child #1] could have it."
5. Staff #2 stated, "I knew [Child #1] could not have egg. No one checked the cupcakes beforehand for eggs. Nothing went off in my head that said not to give [Child #1] a cupcake."

Plan of Correction: Facilitate an allergy plan re training.

Standard #: 22VAC40-185-550-M
Description: Based on documentation review, written record of children's serious injuries were incomplete.

Evidence:
1. An Incident/Accident Report for Parent/Guardian dated 01/28/2021 did not contain staff and parent signatures or two signatures. The Incident/Accident Report contained one staff signature and the signature of the parent/guardian box was blank.

Standard #: 63.2(17)-1720.1-B-4
Description: Based on record review and staff interview, the center did not obtain a copy of the results of a criminal history record check and sex offender registry check from a state in which the staff has resided in the preceding five years by the deadline of December 31, 2020.

Evidence:
1. Staff #2 (Date of hire-02/03/20) lived in Maryland (MD), Hawaii (HI), and California (CA) within the last five years. The results of the criminal history check were not obtained from CA. The sex offender registry checks were not obtained from MD, HI and CA.
2. Staff #3 confirmed that a criminal history background check from the state of CA was not completed and sex offender registry checks from the states of MD, HI, and CA were not completed.

Plan of Correction: Get results of the criminal history check from CA and registry checks from MD, HI, and CA.
