Technical Assistance:
Discussed with director the need to conduct follow up background checks for staff members who have been charged but not convicted of potential barrier crimes.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A monitoring inspection was initiated on February 26, 2021 and concluded on March 1, 2021. The director was contacted by telephone to initiate the inspection. There were 42 children present and 6 supervising staff. The inspector emailed the director a list of items required to complete the inspection. The Inspector reviewed 2 children?s records and 2 staff records submitted by the facility to ensure documentation was complete.



Information gathered during the inspection determined non-compliances with applicable standards or law and violations were documented on the violation notice issued to the facility.

Violations:
Standard #: 22VAC40-185-70-A
Description: Based on record review, two of two staff records reviewed did not contain all required information.
Evidence:
1. The record for Staff 1 (hired 11/30/2020) did not contain documentation that two or more references as to character and reputation as well as competency were checked before employment or volunteering. The references were checked on 2/22/21.
2. The record for Staff 2 (hired 12/22/2020) did not contain documentation that two or more references as to character and reputation as well as competency were checked before employment or volunteering. The references were checked on 2/23/2021.

Plan of Correction: Director will be diligent in C/B with references who are hard to reach.

Standard #: 22VAC40-185-240-A
Description: Based on record review, staff did not receive an orientation training by the end of their first day of assuming job responsibilities.
Evidence:
Staff 1 (Hired 11/30/2020) did not receive an orientation training until 12/5/2020.

Plan of Correction: Orientation was given by director during week in class training. Director will do proper paperwork.

Standard #: 22VAC40-185-550-M
Description: Based on record review, the center did not maintain a written record of children's serious and minor injuries in which entries are made the day of occurrence that contained all required information.
Evidence:
Four accident reports reviewed did not contain: the names of the staff members present during the incident, actions taken to prevent further reoccurrence, when and how the parent was notified, and signatures of a parent and staff member or, alternatively, the signatures of two staff members.

Plan of Correction: Staff were trained today to not only send parent message but also fill out accident/incident hard-copy reports.

Standard #: 63.2(17)-1720.1-B-4
Description: Based on record review, the center did not request the results of an out of state child abuse and neglect registry check from any state in which the applicant has resided in the preceding five years.
Evidence:
Staff 1 (Hired 11/30/2020) had documented residence in another state in the preceding five years on a sworn disclosure statement. The out of state central registry check was not requested until 2/26/2021.

Plan of Correction: Some confusion on college students with VA residency. Director will ask for background check if school is in another state.
