Discussed recordkeeping and reviewed timelines for background checks required by the Code of Virginia

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A renewal inspection was initiated on 03/01/2021 and concluded on 03/01/2021. The director was contacted by telephone to initiate the inspection and the inspection was completed virtually via FaceTime. There were 50 children present and 12 staff. The Inspector reviewed 3 children?s records and 3 staff records submitted by the facility to ensure documentation was complete.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the facility.

The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Violations:
Standard #: 22VAC40-185-40-G
Description: Based on record review and staff interview, the center did not meet the proof of identity and age requirements for 1 of 3 children.

Evidence:
1. Child #1 began attending the center on 11/30/2020. The record for Child #1 did not contain documentation of viewing proof of the child's identity and age within seven business days as required by the Code of Virginia.
2. Staff reported a previous employee reviewed the proof of identification for Child #1 but did not document when the information was viewed. In January 2021, administrative staff reviewed the file and documented viewing the information, outside of the seven business day requirement.

Plan of Correction: Moving forward, we will make a copy of the proof of identity and add the date viewed on the copy until the documentation is completed on our form.

Standard #: 63.2(17)-1720.1-B-4
Description: Based on record review, the center did not obtain a copy of the results of a criminal history record check and a search of the sex offender registry from a state in which the employee has resided in the preceding five years for 1 staff.

Evidence:
1. Staff #1 (first date of employment 11/19/2019) has resided in the state of Texas within the past 5 years. The results of a criminal history record check and sex offender registry check were not obtained from the state of Texas for Staff #1.

Plan of Correction: The center will provide documentation that the out of state criminal history records check and sex offender registry check were completed within 10 business days

Standard #: 63.2(17)-1721.1-B-4
Description: Based on review of Board Officers records, the center did not obtain a copy of the results of a criminal history record check and a search of the child abuse and neglect registry from a state in which the agent has resided in the preceding five years.

Evidence:
1. Agent #1, Agent #2, and Agent #3 have resided in Washington D.C within the past 5 years. The results of a criminal history record check were not obtained from Washington D.C. for Agent #1, Agent #2, and Agent #3.
2. Agent #3, and Agent #4 have resided in Maryland within the past 5 years. The results of a search of the child abuse and neglect registry were not obtained from Maryland for Agent #3 and Agent #4.

Plan of Correction: YMCA has submitted the out of state checks for the said Board Officers. We are currently waiting on state reply.
