Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A monitoring inspection was initiated on April 9, 2021 and concluded on April 12, 2021. A self-reported incident was received by the department regarding allegations in the areas of hazardous substances and supervision. The director was contacted by telephone to conduct the investigation. Staff were interviewed and video of the incident was reviewed.

The evidence gathered during the investigation supported the self-report of non-compliance with the Standards, and violations were issued.

Violations:
Standard #: 22VAC40-185-280-B
Description: Based on interviews with staff and a review of video, the center failed to ensure that hazardous substances such as cleaning materials were kept in a locked place using a safe locking method that prevents access by children.

Evidence:
1. On the morning of April 9, 2021, a child accessed a locked floor level cabinet (under the diaper changing table) that contained multiple cleaning supplies. The cabinet was closed with a child safety strap lock that requires pressure on a "button" and sliding the strap to unlock the mechanism. A 19 month old child accessed the cabinet by unlocking the safety strap. A two year old child picked up a spray bottle of commercial disinfectant spray and sprayed areas which allowed a mist to fall on the 19 month child's face.

Plan of Correction: The cleaning supplies were moved immediately to a locked cabinet where the children are not able to access the locking mechanism.

Standard #: 22VAC40-185-340-F
Description: Based on a review of a video of activities in the toddler classroom and interviews with staff, the center failed to ensure that children under 10 years of age were always within actual sight and sound supervision of staff.

Evidence:
1. One child, age 19 months, was out of sight supervision of two staff on the morning of April 9, 2021 for approximately 13 seconds. Two staff were observed to walk from the area where the child was, around the corner approximately four feet away, to another area (sink area of the classroom) where a full length wall cabinet blocked the immediate view of the child.

2. Another child, age 2 years and 5 months, joined this child at the diaper changing cabinet. Both children were out of sight supervision for an additional 12 seconds (approximately). Two staff were observed to be around the corner of where the two children were at the diaper changing table cabinet during this time.

3. One staff person was observed on the video and confirmed during an interview that she was assisting a third child to use the bathroom and then wash his hands. The second staff person was observed following the first staff person who was assisting the child washing their hands to the sink area around the corner from the diaper changing table. Both staff had their backs to the area in which the two children were at the diaper changing table which prevented sight supervision of the two children.

Plan of Correction: The child care director reminded staff immediately about ensuring sight and sound supervision. The staff will be retrained on the importance of sight and sound supervision.
