63.2(17) License & Registration Procedures

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A monitoring inspection was initiated on April 19, 2021 and concluded on April 22, 2021. The director was contacted by telephone to initiate the inspection. There were 112 children present and 20 staff. The inspector emailed the director a list of items required to complete the inspection. The Inspector reviewed five children?s records and five staff records submitted by the facility to ensure documentation was complete.

Information gathered during the inspection determined non-compliances with applicable standards or law and violations were documented on the violation notice issued to the facility.

The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Violations:
Standard #: 22VAC40-185-60-A
Description: Based on record review, the center failed to ensure that each child had documentation of the name, address, and phone number of two designated people to call in an emergency if a parent cannot be reached.

Evidence:
1. The father of child #1 was listed as an emergency contact. Child #1 first date of attendance was 4/19/2021. The father's information was also listed in the parent section. An additional person, other than a parent, is required to be documented with required contact information.

Plan of Correction: The director will have the parent provide the name, address, and phone number of an additional person other than the parent.

Standard #: 63.2(17)-1720.1-B-4
Description: Based on record review and interview with the director, the center failed to ensure that a copy of the results of a criminal history record information check, and a sex offender registry check was obtained prior to employment for the state where an individual has resided within the last five years.

Evidence:
1. Staff #3, with a documented hire date of 3/12/2021, completed a Sworn Statement on 3/1/2021 disclosing that they had lived in Illinois within the last five years. Illinois is not a National Fingerprint File (NFF) state. Staff #3 did not have a criminal history record check or a sex offender registry check from Illinois as of the date of the inspection.

2. Staff #4, with a documented hire date of 4/07/2021, completed a Sworn Statement on 2/11/2021 disclosing that they had lived in West Virginia within the last five years. West Virginia is a National Fingerprint File (NFF) state. Staff #4 did not have a sex offender registry check from West Virginia as of the date of the inspection.

3. Staff #5, with a documented hire date of 3/21/2021, completed a Sworn Statement on 2/9/2021 disclosing that they had lived in Massachusetts within the last five years. Massachusetts is not a National Fingerprint File (NFF) state. Staff #5 did not have a criminal history record check or a sex offender registry check from Massachusetts as of the date of the inspection.

Plan of Correction: The director will complete the required checks. All checks will be completed prior to employment for future staff hired who have lived in another state within the last five years.
