Comments:
This inspection was conducted by licensing staff using alternate protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

An investigation in response to a self-reported incident was initiated jointly with a local agency on March 24, 2021 and concluded on April 20, 2021. On March 23, 2021, the director contacted the department to report a parent being concerned about marks discovered on their child's legs.

Staff interviews were conducted, staff records were reviewed, and the center's policies and procedures were reviewed in response to the allegations.

The evidence gathered during the investigation did not support non compliance with standards or law. Any violations not related to the self report but identified during the course of the investigation can be found on the violation notice.

Violations:
Standard #: 22VAC40-185-550-L
Description: Based on staff interviews and record review, the center did not notify the parent by the end of the day of any known minor injuries.

Evidence:
1. Child #1's diaper was changed at 9am and 12:30pm by Staff #2, and at 3pm by Staff #3. Staff #2 and Staff #3 stated the marks were not observed on Child #1's legs at those times.
2. Staff #1 stated that when Child #1's diaper was changed at approximately 5pm, marks on [Child #1's] legs. I looked at them and ran my fingers over them. They looked older, so I did not say anything."
3. In an email to the parents of Child #1, Staff #4 stated "...the marks on [their] legs were in fact noticed, but not brought to the attention of [Staff #5], nor was an accident report written because the teacher thought it had already been noticed and addressed. I explained it should have been mentioned no matter what."

Plan of Correction: Staff members will review procedures for reporting injuries and be retrained on procedures and policies.
