Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A complaint inspection was initiated on 03/26/2021 and concluded on 4/16/2021. A complaint was received by the department regarding allegations in the areas of COVID Guidelines, Staffing and Supervision (5), Programs (6). The director was contacted on site to conduct the investigation.

The evidence gathered during the investigation supported the allegation of Programs (6) and Staffing and Supervision (5) of non-compliance with standards or law and violations were issued. Any violations not related to the complaint but identified during the course of the investigation can be found on the violation notice.

Violations:
Standard #: 22VAC40-185-350-E-3
Complaint related: Yes
Description: Based on observation, the facility failed to ensure that children 2 years of age are supervised with one staff member to every 8 children.
Evidence: Observed in the twos classroom, and half-wall, with a baby gate, keeping children on either side of the classroom, clearly separating the two groups. The staff also identified themselves as being in charge of two separate groups. The two staff in group one were asked how many children the two of them were supervising and they stated 11. The one staff member that was in group two was asked how many children she was watching and she stated 9.

Plan of Correction: All classes will remain in ratio at all times. When 2's classrooms is separated, both sides will remain in ratio at all times.

Complaint related: Yes
Description: Based on staff interviews, the facility failed to ensure that they provide awake infants not playing on the floor or ground a change in play space at least every 30 minutes or more often as determined by the individual infant's needs.
Evidence: Identified through staff interviews that children from Nursery 1 and Nursery 2 that are able to hold their heads up and kept in the red baby buggy anywhere from 25 minutes to 1 hour, in order to maintain ratios in the classrooms. Children are removed from the buggy when they need a diaper change, to be fed, or after they fall asleep.

Plan of Correction: Buggy rides will be limited to less than 30 minutes. All awake infants, not playing on the floor, will have a change of play space at least every 30 minutes.

Complaint related: Yes
Description: Based on observation and staff interviews, staff used a forbidden action of enclosing children in a space that the children could not freely exit themselves and used equipment in a way that was not for its intended use.
Evidence: Identified through staff interviews that children are placed in the red buggy in order to maintain ratios in the classrooms on a regular basis. Staff stated that children are in the buggies anywhere from 25 minutes to 1 hour. Sometimes children are placed in the buggies when staff go to lunch and left with the front desk staff, then are picked up and returned to the classroom after their lunch breaks an hour later. When a child falls asleep, needs a diaper changed, or need to be fed, the child is returned to the classroom, where another child takes their place. The consistent use of the red buggy is used mostly during the morning and early afternoons.

Plan of Correction: The buggy will only be used for buggy rides and they will be limited to less than 30 minutes.
