63.2 Child Abuse & Neglect

Technical Assistance:
Discussion of an alleged incident that may have occurred on 04/22/2021. While based on all available facts the allegation of abuse was determined to be Not-Valid; failure to report was determined to be Valid.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A complaint inspection was initiated and concluded on 05/03/2021. This complaint was received by the department regarding allegations in the areas of a forbidden action and failure to report. The Licensing Inspector contacted the director by telephone to conduct the investigation and to interview all applicable staff.

The evidence gathered during the investigation supported (1) of the allegations of non-compliance with the Code of Virginia. A Violation Notice was issued for the Child Day Center (CDC).

Description: Based on interview, a person employed by the center, in their professional capacity as a mandated reporter, who had reason to suspect that a child may have been abused while on site, did not report the matter immediately to the local department of child protective services.

Evidence -
1. On the date of inspection (05/03/2021), Staff #1 stated that an allegation of possible abuse was made aware to the center on 04/26/2021. She investigated the matter and after the investigation ended, Staff #1 concluded that what was reported did not occur.
2. Staff #1 confirmed that this allegation was not immediately reported to Child Protective Services (CPS). In fact, no report was ever filed with CPS by the Child Day Center with regards to this matter.

Plan of Correction: A meeting with parents and staff with regards to this incident has been scheduled. All staff will be reminded of their role as a mandated reporter and that any suspicion of abuse or neglect must be reported immediately to CPS.
