63.2(17) License & Registration Procedures

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A monitoring inspection was initiated on May 7, 2021 and concluded on May 10, 2021. The director was contacted by telephone to initiate the inspection. There were 62 children present and 14 staff. The Inspector emailed the director a list of items required to complete the inspection. The Inspector reviewed 4 children?s records and 4 staff records submitted by the facility to ensure documentation was complete.

Information gathered during the inspection determined non-compliances with applicable standards or law and violations were documented on the violation notice issued to the facility.

Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to me within 5 business days from today. You will need to specify how the deficient practice will be or has been corrected. Your plan of correction must contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Please do not use staff names; list staff by positions only.

Violations:
Standard #: 22VAC40-185-140-A
Description: Based on a review of records and interview on May 10, 2021, the center did not obtain documentation of a physical examination by or under the direction of a physician for each child before the child's attendance or within one month after attendance.
Evidence: 1. The record of Child #1 (DOE 10/1/19) contained documentation of a physical dated 1/14/20.
2. Administration acknowledged that was the only physical in the file for Child #1.

Plan of Correction: Will be sure to receive physical prior to or within 30 days of start.

Standard #: 22VAC40-185-40-G
Description: Based on a review of records and interview on May 10, 2021, the center did not ensure that regulated child day programs require proof of child identity and age; report to law enforcement agencies.
Evidence: 1. The record of Child #1 (DOE 10/1/19) contained documentation of viewing the proof of the child's identity and age dated 10/14/19. There was no documentation of the center notifying law enforcement when proof of age and identity as not received within seven business days of initial attendance.
2. Administration acknowledged the proof of identity wasn't checked timely.

Plan of Correction: Will be sure to receive/view birth certificate within 7 days of start.

Standard #: 63.2(17)-1720.1-B-4
Description: Based on a review of records and interview on May 10, 2021, the center did not ensure to obtain a copy of the results of a criminal history record information check and sex offender registry check from any state in which the employee has resided in the preceding five years by the deadline of December 31, 2020 for employees hired prior to July 1, 2020.
Evidence: 1. The record of Staff #4 (DOH 7/24/18) did not contain documentation of results of an out-of-state criminal history record check and sex offender registry check.
2. Administration asked if this was a standard in 2018 when Staff #4 was hired.

Plan of Correction: Will send out-of-state checks immediately.
