63.2(17) License & Registration Procedures

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
A monitoring inspection was initiated on May 12, 2021 and concluded on May 13, 2021. The person in charge was contacted by telephone to initiate the inspection. There were 13 children present and 5 staff. The inspector emailed the person in charge a list of items required to complete the inspection. The Inspector reviewed 2 children?s records and 2 staff records, these records were submitted by the facility to ensure documentation was complete. Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the facility.

The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Violations:
Standard #: 22VAC40-185-60-A
Description: Based on record review and staff interviews, the licensee did not ensure to maintain a separate record for each child enrolled containing all required information.

Evidence: The record for Child #2 did not include the addresses for both emergency contacts listed.

Plan of Correction: The addresses for both emergency contacts were added to the child's record.

Standard #: 22VAC40-185-410-2
Description: Based on staff interviews, the licensee did not ensure children preschool age or younger were not placed in an enclosure or a small confined space or any space the child cannot freely exit himself; however, this does not apply to the use of equipment such as cribs, play yards, high chairs, and safety gates when used for their intended purpose.

Evidence: During inspection the center's discipline policy was discussed and Staff #2 indicated they try to redirect a child's behavior and "in worst case scenario" children under two years of age are "put in a highchair for one to two minutes". The highchair is not being used for the intended purpose.

Plan of Correction: Director educated staff on the proper use of the highchair and explained that it should only be used for its intended purpose (feeding time). Children are not to be confined in the highchair for disciplinary purposes. Director contacted a Child Care specialist for training in redirection for toddlers

Standard #: 22VAC40-185-540-E
Description: Based on observation and staff interviews, the licensee did not ensure there was one working, battery-operated radio.

Evidence: The center director confirmed the batteries were not working for the radio.

Plan of Correction: Batteries were purchased for the radio.

Standard #: 22VAC40-185-550-M
Description: Based on documentation review and staff interviews, the licensee did not ensure the center maintain a written record of children's serious and minor injuries in which entries are made the day of occurrence and includes all required information.

Evidence: Three injury reports were available for review and were determined incomplete. The following information was missing
1) Two reports did not include staff present during injury and date and time parents were notified of injury.
2) Three did not include any future action to prevent recurrence of the injury, staff and parent signatures or 2 staff signatures and how parent was notified.

Plan of Correction: The Department of Social Service model form for injury reports will be used for future incident. Director will check all future incident reports before parents sign the form and forms are filed to ensure they include the correct information.

Standard #: 63.2(17)-1720.1-B-2
Description: Based on record review and staff interviews, the licensee did not ensure staff submit to fingerprinting and obtain results prior to employment.
Evidence: Staff #2 was hired on 1/21/21 but the fingerprint results were not received until 1/28/21. Center owner confirmed Staff #2 was working in the center prior to receiving the fingerprint results.

Plan of Correction: Director will ensure staff fingerprint results are obtained before the first day of employment.

Standard #: 63.2(17)-1720.1-B-4
Description: Based on record review and staff interviews, the licensee did not ensure to obtain a copy of the results of a criminal history record check (CRC) and child abuse and neglect search (CPS) from any state in which the staff has resided in the preceding five years. CRC results must be received prior to the first day of employment.

Evidence: The record for Staff #1 included a sworn statement documenting they had lived outside of of Virginia within the last 5 years (Connecticut). Staff #1 was hired on 3-5-21 and a CRC and CPS had not been obtained for the state of Connecticut. Center owner confirmed a Connecticut CPS check has not been submitted and the results for the Connecticut CRC have not been received. Center staff confirmed staff #1 was working during the inspection.

Plan of Correction: Staff was sent home 5/13/2021 and will not return to the center until Connecticut background checks and central registry results are obtained.
