Effective July 1, 2020 SB 668 requires licensed child day centers to obtain a copy of the results of a criminal history name search and sex offender registry check from any state in which the individual has resided in the preceding five years prior to hire. This is in addition to the central registry check from any state in which the individual has resided in the preceding five years that was already required within 30 days of hire.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A monitoring inspection was initiated on 5/18/21 and concluded on 5/20/21. The director was contacted by telephone to initiate the inspection. There were 127 children present between the ages of three months to nine years and 24 staff. The inspector emailed the director a list of items required to complete the inspection. The Inspector reviewed five children?s records and five staff records submitted by the facility to ensure documentation was complete. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the facility.

The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Violations:
Standard #: 63.2(17)-1720.1-B-2
Description: Based on review of five staff records and interview, the center did not obtain documentation of the results of a national fingerprint background check prior to date of hire for one staff. Evidence: The record for Staff C, with a hire date of 5/10/21 does not contain documentation of the results of a national fingerprint background check and staff confirmed it had not yet been received.

Plan of Correction: We have been following up regarding the fingerprint check but it's taking longer than usual and I've had to send the staff home. Moving forward we will not have staff start without having the required background checks when they are required.

Standard #: 63.2(17)-1720.1-B-4
Description: Based on record review and interview, the center did not obtain the results of a criminal history record check or sex offender registry check from all states in which staff members have resided within the past five years prior to hire, or the results of a central registry check from all states in which staff members have resided within the past five years within 30 days of hire.

Evidence: 1. Staff A, with a start date of 1/25/21, disclosed on their sworn statement that they had resided in New Jersey and California within the past five years. The criminal history record check from California that was submitted for the staff was dated 5/17/21 and did not yet have results on record; the results of the sex offender registry check from California were dated 5/17/21 and the results of the check from New Jersey were dated 5/18/21; the results of a search of the central registry for California were not on record.

2. Staff B, with a start date of 3/22/21, disclosed on their sworn statement that they had resided in Florida within the past five years. The results of a search of the central registry for Florida were not on record.

3. Staff C, with a start date of 5/10/21, disclosed on their sworn statement that they had resided in Alabama and Texas within the past five years. The criminal history record check for Alabama that was submitted for the staff was dated 5/18/21 and did not yet have results on record and the check for Texas was dated 5/17/21; the results of the sex offender registry check for Alabama were dated 5/17/21 and the results for Texas were dated 5/17/21.

Plan of Correction: We were unclear on the out-of-state background check requirements and timelines, however, we now understand them and will ensure the required background checks are on file when required.
