22VAC40-185 STAFFING AND SUPERVISION.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A complaint inspection was initiated on 3/2/2021 and concluded on 5/2/2021. A complaint received by the department regarding allegations in the areas of supervision and ratio. The director was contacted by telephone to conduct the investigation. The inspector emailed the director a list of documentation required to complete the investigation.

The evidence gathered during the investigation supported the allegations of non-compliance with standards or law and violations were issued.

Violations:
Standard #: 22VAC40-185-340-A
Complaint related: Yes
Description: Based on interviews and video, the center failed to ensure that care, protection and guidance was given to children in care.

Evidence:
1. Verified by the staff # 1, staff # 1 left the building to go purchase lunch supplies and left six children unsupervised for approximately 15-20 minutes. While staff # 1 was gone, child # 1 was hit on the head and neck area approximately six times from another student.
2. The video showed child# 1 on the ground while the other child was hitting child # 1. The medical reports stated that there was soft tissue swelling overlaying C7 vertebra.

Plan of Correction: Whenever staff has to leave the building the children ca go in to the community with staff and we are constantly hiring staff and will will continue to hire until we have appropriate staff as well as not accept more children into the program. Per the owner.

Complaint related: Yes
Description: Based on observation of a video and interviews, the center failed to ensure that all children under 10 years of age were within sight and sound supervision.

Evidence:
1. The video showed six school age children in the large classroom with no supervision. The children ages were 5-11 years old.
2. Verified through interviews with the staff #1 that children were left by themselves while staff # 1 went to the store for lunch items. There were two adults in the infant room which is located on the other side of the building. Staff # 2 verified that they were not within sight and sound supervision of staff.

Plan of Correction: The director stated that she will not leave the building when she is in charge of a grouping of children. Per the owner.

Standard #: 22VAC40-185-350-C
Complaint related: Yes
Description: Based on video and interviews, the center failed to ensure when a mixed age group is together that the ratio applies to the youngest child in the group.

Evidence:
1. Verified through interviews with staff, the grouping of 19 children ages 2 year old's to 8 year old's were outside with one staff person. Staff person stated that this was a normal grouping of children. the ratio should be 3 staff for this grouping.

Plan of Correction: We are now aware of the ratio errors and we work daily to assure that we are in ratio at all times and all staff is constantly reminded to never leave a child unattended at any time for any reason. Our facility has also started to received extra training from outside recourses to assure out children are safe and protected at all times. Per the owner.
