63.2(17) License & Registration Procedures

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A monitoring inspection was initiated on May 25, 2021 and concluded on June 2, 2021. The director was contacted by telephone to initiate the inspection. There were seventy-eight children in the care of twenty-five staff. The inspector emailed the director a list of items required to complete the inspection. The Inspector reviewed five children?s records and eight staff records submitted by the facility to ensure documentation was complete.

Information gathered during the inspection determined non-compliances with applicable standards or law and violations were documented on the violation notice issued to the facility. The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Please complete the plan of correction and date to be corrected sections for each violation cited on the violation notice and return it to me within 5 business days from today. You will need to specify how the deficient practice will be or has been corrected. Just writing the word `corrected? is not acceptable. Your plan of correction must contain: 1) steps to correct the noncompliance with the standard(s): 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s).

Violations:
Standard #: 63.2(17)-1720.1-B-4
Description: Based on review of eight staff files, program did not ensure a criminal history check, a sex offender registry check, nor a search of the child abuse and neglect registry was completed from any state in which an individual resided within the preceding five years.

Evidence:
1. Date of employment for Staff #1 is 12/7/20. The sex offender check in file was dated 5/26/21. There were no child abuse and neglect checks for either of the two other states of residency. There was no criminal history check for one of the other states of residency.
2. Date of employment for Staff #6 is 5/10/21. The sex offender check in file was dated 5/26/21. There were no child abuse and neglect checks for either of the two other states of residency. There was no criminal history check for one of the other states of residency.

Plan of Correction: Program?s Immediate Response
After seeking clarification for the requirement to submit central registry request within 7 days of hire, and the state requirements for background checks both in and out-of-state, we re-checked all recent hires to ensure all requests were made.. Further, the center director noted in each employee?s folder the date the request were mailed. An event reminder will be placed on the Center Director?s calendar to resubmit the request and follow up every two weeks for those not
received within 30 days.. These requests will be documented for further accountability of all attempts to obtain these results.
Ongoing Corrective Action Steps
In response to this incident, the Center Director will place a follow-up reminder event on her calendar for 30-days after making an initial request for central registry results to ensure the center obtain requested results or has documentation of all attempts to receive them. Furthermore, the center director will ensure receipt of background checks from all states applicable to new employees.
Conclusion
The Center values our relationship with the Division of Licensing Programs and is committed to meeting all licensing requirements and operating the highest quality program. The Center took immediate and effective steps to respond to this citation, correct the deficiency and to develop a plan for the future designed to prevent further occurrences.
