Technical Assistance:
We discussed the requirements for submitting requested information to licensing staff, background checks for staff at the time of employment, staff and children's records.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A monitoring inspection was initiated on May 25, 2021 and concluded on May 25, 2021. The administrative staff person was contacted by video call to initiate the virtual inspection. There were fifteen children present and two to three staff. The inspector emailed the administrative staff person the information needed to complete the inspection. The Inspector reviewed two children?s records and four staff records submitted by the facility to ensure documentation was complete.

Information gathered during the inspection determined there were non-compliances with applicable standards or law and violations were documented on the violation notice issued to the facility.

The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Violations:
Standard #: 22VAC40-185-130-A
Description: Based on a review of records for children, and an interview with administrative staff, the center failed to obtained the documentation that each child has received the immunizations required by the State Board of Health before the child can attend the center. Evidence: The only immunization record in the file for child 1 was from immunizations administered after birth in 2017.

Plan of Correction: Child 1 has not attended since April due to a change with the parent's work schedule. Administrative staff attempted to reach the parents on May 27, 2021 to request the most recent immunization record. The record will be obtained by the time the child resumes attending the center.

Standard #: 22VAC40-185-140-A
Description: Based on a review of records for children, and an interview with administrative staff, the center failed to ensure that each child had a physical examination by or under the direction of a physician within the last twelve months prior to the enrollment date and the report submitted to the center no later than the first month of attendance. Evidence: Child 1 began care February 21, 2021. There was not a physical examination record completed in the last twelve months in the file as required for preschool age children.

Plan of Correction: Child 1 has not attended since April due to a change with the parent's work schedule. Administrative staff attempted to reach the parents on May 27, 2021 to request a physical examination record. The record will be obtained by the time the child resumes attending the center.

Standard #: 22VAC40-185-70-A
Description: Based on a review of staff records, and an interview with administrative staff, the center failed to ensure that all required information was included in staff records. Evidence: There was only one reference check documentation located in the file for staff member 1 who was re-hired on April 9, 2021. The employment date for staff member 3 was March 8, 2021. Staff member 4 confirmed that staff member 3 received orientation training at the same time as her on March 8. 2021. There was not any documentation of the orientation training in the file for staff member 3. Staff member 1 began employment on April 9, 2021 and there was not a TB screening statement in the staff record. Staff member 2 began employment on May 11, 2021 and there was not a TB screening statement in the staff record. Staff member 3 began work on March 8, 2021 and there was not a TB screening and statement in the staff record.

Plan of Correction: Administrative staff will complete and add the orientation checklist form to the file for staff member 3.
Administrative staff who conduct orientation training with new staff will use the orientation form to document the training at the time it is conducted.

Standard #: 22VAC40-185-280-G
Description: Based on a review of cleaning and sanitizing solutions used daily, observations of the substances stored for use by staff, and interviews with staff, the center failed to ensure that when hazardous substances were not kept in original containers, the substitute containers clearly indicated their contents. Evidence: A spray bottle in a storage cabinet was labeled with the manufacturer's title "Master Blaster". The contents of the solution seen inside the bottle was not written anywhere on the bottle. When asked about the contents, staff member 2 said it smelled like "Pine-Sol" cleaner. During an additional staff interview, the licensing inspector was shown a larger original container of Lysol cleaner used to pour the solution into the spray bottle.

Plan of Correction: A teacher labeled the spray bottle on the day of the inspection. Administrative staff will instruct the staff to make sure spray bottles are always labeled to indicate the actual contents.

Standard #: 22VAC40-191-60-C-2
Description: Based on a review of staff records, and an interview with administrative staff, the center failed to ensure that a Virginia Central Registry finding was obtained for all staff within thirty days of initial employment. Evidence: The start date for staff member 3 was written in the record as March 8, 2021. There was not any proof of a completed Virginia Central Registry request form, documentation of the date it was sent to Richmond, any documentation of follow-up with the agency in Richmond, or results of a finding in the staff record. When questioned by the licensing inspector, administrative staff did not state a request was completed.

Plan of Correction: Administrative staff will ensure that Virginia Central Registry findings request forms are completed by new employees and sent to the agency in Richmond within the first month of employment. Staff member 3 will not return as a paid employee without timely obtainment of all required background checks.

Standard #: 63.2(17)-1720.1-B-2
Description: Based on a review of staff records, and an interview with administrative staff, the center failed to ensure that a criminal history record check finding was obtained before initial employment for all new staff after ensuring potential employees submitted to fingerprinting and provided personal descriptive information as required in the Code of Virginia. Evidence: There was not the results of a criminal history record check located in the file of staff member 3. Administrative staff indicated there was a problem with staff member 3 not brining all required information the day of a Fieldprint appointment for fingerprinting. According to the staff record, the first date of employment was March 8, 2021. Administrative staff indicated that staff member 3 was hired without the required background check and has been working as a floater, relieving staff for breaks, and a paid employee since that date. .

Plan of Correction: Staff member 3 was informed on May 25 2021 that she will not be able to work at the center until the required fingerprinting and results of the criminal history record check are obtained. In the future, staff will not be employed until the background checks required in advance of employment are obtained.
