Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
A monitoring inspection was initiated on 5/18/2021 and concluded on 5/27/2021. A self-reported incident was received by the department regarding allegations in the areas of programs. The director was contacted by telephone to conduct the investigation. The inspector emailed the director a list of documentation required to complete the investigation.
The evidence gathered during the investigation supported the self-report of non-compliance with standards or law and violations were issued. Any violations not related to the self-report but identified during the course of the investigation can be found on the violation notice.

Violations:
Standard #: 22VAC40-185-360-A
Description: Based on the video recording provided by the center, staff interview and review of documentation, children attending a 3 year old classroom were engaged in a activity that was not age and stage appropriate.

Evidence:
1. On 5/17/2021, Staff#1 brought a group of children, attending a 3 year old classroom, to the program?s multipurpose room and recorded a running activity during PE class. 7 children were observed standing side-by-side with their backs against the wall. The 7 were observed running towards the staff person (on the opposite side of the room) while 2 additional children swung foam pool noodles, trying to tag the running children.
2. This activity was not age and state appropriate and caused a child to be injured by tripping over another child that had fallen to the ground.
3. Staff #1 and the program director confirmed the incident occurred on 5/17/2021 and that a child was injured.
4. An incident report confirmed that a child was injured during this activity.

Plan of Correction: The PE teacher will make sure all games are ages and stages appropriate.
