Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A complaint inspection was initiated on 05/20/2021 and concluded on 05/21/2021. A complaint was received by the department regarding allegations in the areas of forbidden action and operational responsibilities. The director was contacted by telephone and video call to conduct the investigation.
The evidence gathered during the investigation supported the allegations of non-compliance with standards or law and violations were issued.

Complaint related: Yes
Description: Based on observation and documentation review, the center did not ensure to maintain confidentiality of personal information.
Evidence:
1. On 5/11/2021, a video was posted on a social media platform showing Teacher A and Teacher B saying demeaning remarks regarding children in care while showing several children?s faces after each remark.
2. The inspector reviewed the files for all thirteen children who were shown on the video described above. Three of the thirteen children?s records contained a photo release form stating that the parent does not give permission for any photos of the child to be used.
3. The center?s Social Media Policy states the following: ?Post only appropriate and respectful content [.] Never post the names or any photographs of the children who attend the center where you are employed.?

Plan of Correction: Correction: 1. The teachers were immediately terminated. 2. All teachers have received additional training on confidentiality and social media policy. 3. Individual conferences with parents of the three children who are not allowed to be on any social media.
Prevention: 1. Each classroom (teacher) will have documentation for children that are not allowed on any social media. 2. Each classroom has its own tablet which is used for communication with parents. 3. No personal devices are allowed in the classrooms. Person(s) Responsible: 1. [Director] 2. Description: Based on observation of a video recording, the center did not ensure staff refrain from using a forbidden action such as verbal remarks which are demeaning to the children in care.
Evidence:
On 5/11/2021, a video was posted on a social media platform showing Teacher A and Teacher B saying demeaning remarks regarding children in care. The video revealed Teacher A and Teacher B saying, ?I am passing the phone to? and then stating various descriptions of the children where some of the descriptions were demeaning. The camera would then show each child after the remark. Teacher A and Teacher B stated the following about the children: Child #1 ?the one with a stutter?, child #2 ?a cry baby?, child #3 ?a horse girl?, child #4 ?a girl who thinks she can dance?, child #5 ? the kid with a crooked hairline?, child #7 ?serious attachment issues?, child #8 ?a girl whose clothes never fit her?, child #9 ?a child genius?, child #10 ?a drama queen?, child #12 ?a girl who always has her shoes on the wrong feet?, child #13 ?my best friend?. Based on several reviews of the video, the statements regarding child #6 and #11 were not able to be clearly understood.

Plan of Correction: Correction: 1. The teachers were immediately terminated. 2. Talked with all parents whose children were involved and explained the situation and reassured them that actions have been taken to avoid any future incidents. 3. Meeting held with all staff to review social media policy. Prevention: 1. Staff are not allowed to have any devices in classroom. 2. Social Media policy will be addressed at monthly staff meetings. 3. Future employees will receive specific social media orientation. Person(s) Responsible: 1. [Director] 2. [Administrative Director]
