Technical Assistance:
Discussed the staff's responsibility as mandated reporters to report incidents of suspected abuse or neglect to Child Protective Services.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A monitoring inspection was initiated on 05/26/2021 and concluded on 06/03/2021 to investigate a self-reported incident received by the department involving the area of supervision. The director was contacted by telephone to conduct the investigation. The inspector emailed the director a list of documentation required to complete the investigation. Interviews were conducted with staff, documents were reviewed and staff/child records were reviewed.

The evidence gathered during the investigation supported the self-report of non-compliance with standards or law and violations were issued. Violations:
Standard #: 22VAC40-185-40-E
Description: Based on interview of staff, documentation review and observation of the center's video recording, it was determined that staff failed to follow the center?s own policies & procedures on supervision.
Evidence:
1) Staff #3 stated (during an interview on 05/26/2021) that the center?s supervision and safety rules include doing a name-to-face check, using the Tadpoles app on the iPad, at each threshold during transitions.
2) Kiddie Academy?s Supervision Policy states the following: ?As staff monitor and supervise children, name to face attendance is documented in Tadpoles?
3) According to the New Employee Orientation Guide provided by the center, playground safety training and supervision training were completed by Staff #1 on 03/06/2019 and by Staff #2 on 02/23/2018.
4) The center's video recording from 05/20/2021 of the Apricot?s (2 year olds) classroom showed the following: At mark 0:56 of the video Staff #1 entered the classroom with 3 children. Approximately 30 seconds later, at mark 4:36 of the video, Staff #2 entered the classroom with 6 children. At the video?s 4:36 mark, while standing in front of the classroom?s sink washing the hands of some children, Staff #1 pointed across the room while speaking to Staff #2, walked towards the playground door and let Child #1(2 years old) inside the classroom.
5) Staff #3 stated that the incident observed on the 05/26/2021 recording occurred at approximately 11:26 am.
6) Staff #1 stated (during an interview on the day of inspection) that: a- ?I took some kids [inside] with me,? Staff #2 ?went back in and forgot? Child #1 b- ?We forgot to count? c- ?We take turns doing face-to-name but that day we didn?t do it? d- Child #2 ?was outside like 2 minutes?
7) Staff #2 stated (during an interview on the day of inspection) that: a-?[Staff #1] went inside first with the iPad and then I went inside with the rest of the kids? b- ?Once inside, they start washing hands and [Staff #1] saw that [Child #1] was outside? c- ?I think it was like 3 minutes? d- ?I didn?t count. I didn?t know if [Staff #1] counted?. Staff #2 stated that the center?s policies require that staff complete name-to-face check of the children when coming back from the playground.
8) Employee Counseling Forms for Staff #1 and Staff #2 dated 05/26/2021 both document that ?Teacher did not complete name-to-face when entering the classroom?? and ?Name-to-face must ALWAYS be done when exiting or entering the classroom?

Plan of Correction: All staff attended a staff meeting and reviewed the center's supervision policy and name-to-face policy in detail. All staff re-signed the supervision policy to be placed in their file.

Standard #: 22VAC40-185-340-F
Description: Based on observation of the center's video recording and staff interviews, it was determined that staff did not ensure that children were always within actual sight and sound supervision.
Evidence:
1) The center's video recording from 05/20/2021 of the Apricot?s (2 year olds) classroom showed the following: At the video?s 0:56 mark Staff #1 entered the classroom with 3 children. Approximately 30 seconds later, Staff #2 entered the classroom with 6 children. At the video?s 4:36 mark, while standing in front of the classroom?s sink washing the hands of some children, Staff #1 pointed across the room while speaking to Staff #2, walked towards the playground door and let Child #1 (2 years old) inside the classroom.
2) Staff #1 stated that on 05/26/2021 they were washing the kids? hands before lunch when they noticed that Child #1 (2 years old) was outside of the classroom door, on the playground, knocking on the door asking to be let in.
3) Staff #2 stated that Staff #1 went in the classroom from the playground first and took some children with them. Staff #2 gathered the remainder of the children and then entered the classroom. Both, Staff #1 and #2 admitted that they came back from the playground about 2-3 minutes before Child #1 was seen outside the door from the playground.

Plan of Correction: Staff reviewed supervision policy and name-to-face policy in detail. Administration will continue to check name-to-face logs to ensure compliance.
