Description: Based on review of five board officers and/or agents? records, the licensee did not obtain a fingerprint
based national criminal history check for one board officer within the required timeframe.

Evidence:

1. The record for Board Officer #2 (Board Officer since October 2019) contained a sworn statement
dated May 18, 2021 and the results of a central registry check dated January 9, 2020.
2. Sworn statements are required to be obtained when a board officer and/or agent has been
appointed.
3. Results of a central registry check by end of 30 th day of an individual becoming a board officer
and/or agent.

Plan of Correction: All missing documentation has been obtained

Description: Based on review of five board officers and/or agents? records, the licensee did not obtain a fingerprint

1. The record for Board Officer #2 (Board Officer since October 2019) contained the results of a
fingerprint based national criminal history check dated June 21, 2021.
2. Board officers and/or agents are required to obtain results of a fingerprint based national
criminal history check by end of 30 th day of an individual becoming a board officer and/or agent.

Description: Based on review of five board officers and/or agents? records, the licensee did not ensure four board
officers and/or agents who lived outside of Virginia in the past five years included interstate criminal
history record and sex offender registry searches within the required timeframe.

Evidence:

1. The record for Board Officer #1 (Board Officer since March 2016) indicated the officer has resided in
two states outside of Virginia within the last five years. The results of a sex offender registry search from
the two other states Board Officer #1 resided were obtained on June 10, 2021.
2. The record for Board Officer #2 (Board Officer since October 2019) indicated the officer has resided in
a state outside of Virginia within the last five years. The result of a sex offender registry search from the
other state Board Officer #2 resided was obtained on June 10, 2021.
3. The record for Board Officer #3 (Board Officer since July 2013) indicated the officer has resided in a
state outside of Virginia within the last five years. The result of a sex offender registry search from the
other state Board Officer #3 resided was obtained on June 10, 2021.
4. The record for Agent #1 (Agent since May 2010) indicated the agent has resided in a state outside of
Virginia within the last five years. The result of a sex offender registry search from the other state Agent
#1 resided was obtained on June 9, 2021. The result of an interstate criminal record search was obtained
on June 11, 2021.
5. All individuals who were operating as board officers and/or agents prior to July 1, 2020 were required
to obtain interstate criminal history record and interstate sex offender registry search by December 31,
2020.
