22VAC40-185 PROGRAMS.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A monitoring inspection was initiated on 06/09/2021 and concluded on 06/21/2021. A self-reported incident was received by the department regarding allegations in the areas of 22VAC40-185-400. The Center Supervisor was contacted by telephone to conduct the investigation. The inspector emailed a list of documentation required to complete the investigation. The evidence gathered during the investigation supported the self-report of non-compliance with standards or law and violations were issued.

Violations:
Standard #: 22VAC40-185-400-B
Description: Based on interviews, behavioral guidance was not constructive in nature, age appropriate, and did not redirect the child to appropriate behavior, resolving the conflict.

Evidence:
1. Child A was sitting in the teacher's chair and would not get up after being repeatedly asked to do so. Staff A placed their hand on Child A's back to guide them out of the chair.
2. Child A told Staff B, "[Staff A] pushed me".
3. Child A told Adult 1, "[Staff A] put their hands on me".
4. Staff A stated "I directed [Child A] multiple times, nicely, to get out of the teacher's chair. Yes, I did put my hand on Child A's back and then Child A pushed up against my hand. If my hand hadn't been there, the child would've fallen and hurt themselves".

Plan of Correction: Staff will receive additional training in guiding children?s behavior and developing relationships with children. Training will include age appropriate and constructive behavioral guidance strategies and conflict resolution strategies. Staff will implement constructive behavioral guidance strategies and redirect children to appropriate behaviors and activities in order to resolve conflicts.
