22VAC40-191 Background Checks (22VAC40-191)
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
A complaint inspection was initiated on April 13, 2021 and concluded on June 29, 2021. A complaint incident was received by the department on April 9, 2021 regarding allegations in the areas of character and reputation and staff submission of tuberculosis screening statements. The administrator was contacted by telephone during the investigation. All interviews were initiated and conducted by telephone.
After completing pertinent interviews, and a review of pertinent documentation, the evidence gathered during the investigation did not support the allegations of non-compliance with standards or law. There was not sufficient evidence for a valid complaint. However, the requirement for locking files containing staff background check information was not initially reported as a complaint allegation, but found in violation.
Standard #: 22VAC40-191-70-E Complaint related: No Description: Based on interviews, the center failed to ensure that the sworn statement or affirmations, criminal history record reports, and central registry findings for staff were kept in locked files. Evidence: Administration staff indicated that the office file container for staff files did not have a lock. Also, that there was not a key to use to lock the office door. Plan of Correction: The administrator installed a way to lock both the staff file container and the office door by the week of May 10, 2021. The staff files will be kept locked and inaccessible to anyone other than administrative staff.
