Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A monitoring inspection was initiated on 04/09/2021 and concluded on 07/08/2021. A self-reported incident was received by the department regarding allegations in the areas of the supervision of children. The investigation was conducted jointly with a local agency. The director was contacted by telephone to conduct the investigation. The inspector emailed the director a list of documentation required to complete the investigation.

The evidence gathered during the investigation supported the self-report of non-compliance with standards or law and violations were issued. Any violations not related to the self-report but identified during the course of the investigation can be found on the violation notice.

Please complete the 'plan of correction' and 'date to be corrected' for each violation cited on the violation notice and return it to me within 5 business days from the date of receipt. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standards, 2) measures to prevent the noncompliance from occurring again, and 3) person(s) responsible for implementing each step and/or monitoring any preventative measure(s).

Violations:
Standard #: 22VAC40-185-340-A
Description: Based on a review of documents and interviews, the center did not ensure that when staff are supervising children, they shall always ensure their care, protection, and guidance.

Evidence: 1) On 04/07/21, at approximately 11:00am, Child #1 (18-months-old) was bit by another child on the playground. Collateral interviews reported approximately eight bite marks were observed throughout Child #1?s body when they were picked up from the center on 04/07/21. Two of the marks broke the child?s skin.
2) Staff #1 completed a written accident/injury report form on 04/07/21 describing Child #1?s injuries: ?We thought the students were hugging but when [Child #1] went to the ground, we went over to dust him off and observed the marks?
3) Staff #1, Staff #2, Staff #3, Staff #4, and Staff #5 were present on the playground at approximately 11:00am when the incident occurred. The staff members were not able to identify how another child bit Child #1 eight times and nobody noticed until Child #1 was on the ground. Three different groups of children (Toddlers, Two?s, and Three?s) were out on the playground on 04/07/21. The staff members reported that when all groups are outside, all staff members are responsible for the care and protection of each child regardless of their assigned group.

Plan of Correction: Per the Center: "Since the biting incident we came up with a plan that the two's and pre-schooler would go out separate. We also had a staff meeting so that everyone is onboard with the plan because we do have teachers from the big center to sub in that class. Each class goes out for 45 minutes and the next class follows. The Toddlers have their own space they don't have share their time with anyone."

Standard #: 22VAC40-191-60-B
Description: Based on a review of two staff records, the center did not ensure that one out of two staff had a completed sworn statement prior to hire.

Evidence: 1) The record for Staff #1, hired on 09/22/2020, contained a sworn statement that was dated 10/05/2020. An employee or volunteer of a licensed or registered child welfare agency or of a family day home approved by a family day system must not be employed or provide volunteer service until the agency or home has the person's completed sworn statement or affirmation.

Plan of Correction: Per the Center: "Upon applicants filling out an employee package I double check to make sure all the papers are in the hire package and the date are signed for the hire date."
