Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, and a virtual tour of the program.

A monitoring inspection was initiated on 7/19/2021 and concluded on 7/27/2021. The director was contacted by telephone and a virtual inspection was conducted. There were 24 children present, ranging in ages from 2 years old to 4 years old, with 4 staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of 4 child records and 4 staff records were reviewed.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22VAC40-185-130-A
Description: Based upon a review of records and interview, the licensee did not obtain a copy of each child's immunization record prior to enrollment.
Evidence:
1. Four children's records were reviewed during today's inspection.
2. The record for child #1 did not contain documentation of immunizations.
3. Child #1 began attending the program 7/6/2021.
4. The director stated that she thought children had 30 days before the immunization record had to be obtained.

Plan of Correction: The director stated that she would request the child's immunization record from his parent today (7/26/2021) and will have the documentation in the record for child #1 by no later than 8/6/2021.

Standard #: 63.2(17)-1720.1-B-4
Description: Based on a review of records and interview, the licensee did not obtain a copy of the results of a criminal history record information check, a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from any state (other than Virginia) in which the individual has resided in the preceding five years.
Evidence:
1. Four staff records were reviewed during today's inspection.
2. The record for staff #4 contained a signed Sworn Disclosure form which indicated that the individual had resided in the state of Utah within the past 5 years.
3. The record did not contain the results of a Criminal History Record check, search of the Central Registry or search of the State sex Offender registry for the state of Utah.

Plan of Correction: The director stated that she was not aware that these out of state background checks had to be requested. She stated that she will request the Criminal History Record check, search of the Central Registry and search of the State sex Offender registry for the state of Utah by the end of the day on 7/27/2021 and send the results to the inspector upon receipt.
