63.2 Child Abuse & Neglect

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review and interviews.

A complaint inspection was initiated on 06/11/2021 and concluded on 06/25/2021.
A complaint was received on 06/11/2021 regarding allegations of inappropriate behavior guidance and a lack of injury documentation.

Based on the information gathered which included staff and child interviews and record review this complaint is found to be valid.

Violations were found in the areas of staffing and supervision, programs and special care provisions and emergencies. These violations are listed on the violation notice and were reviewed with administrative staff at the complaint exit interview.

Description: Based on interview and record review, the center failed to ensure the following ratios of staff to children are required wherever children are in care:
For children from three years to the age of eligibility to attend public school, five years by September 30; one staff member for every 10 children.

Evidence:
1. Written attendance records from the facility indicate the 5-4 Pre-Kind 1 class did not have sufficient staff on the morning of 06/10/2021:
a. 1 staff to 13 children at 7:45 am;
b. 1 staff to 14 children at 8:00 am;
c. 1 staff to 12 children at 8:15 am;
d. 1 staff to 12 children at 8:30 am;
e. 1 staff to 13 children at 8:45 am.
2. Staff 1 stated that she was alone with more than 10 children from approximately 7:30 am until 9 am when a second staff arrived.
3. Staff 2 stated that when she arrived there were 16 children in the 5-4 Pre-K 1 class with staff 1.
4. Two staff were needed beginning at 7:45 am as there were more than 10 children in the class.

Plan of Correction: *August 9, 2021 - Upon greeting the children at the door, teachers will immediately sign children into their classroom on Procare.
*August 9, 2021 - Implementing a reminder system for teachers to complete name to face checks on a regular basis. Leadership will continue to walk or facetime each classroom for ratio checks.
*June 12, 2021 - Primrose Owner, visited each classroom and reminded teachers to CLOCK IN and OUT on their classroom IPAD.
*June 18, 2021 - In service training was held and all three areas were discussed by Education Coach and proper procedure shared on Staff/To Child Ratio.

Description: Based on staff and child interviews, the center failed to ensure that behavior guidance shall be constructive in nature and age and stage appropriate.

Evidence:
1. Child 1, age five years, hit his head on the edge of a cot when staff 1 pulled the cot across the floor during nap time on 06/10/2021 in order to quite him.
a. This resulted in child 1 having a scratch and bruise on his forehead.
2. Staff 1 stated that child 1 "was on his hands and knees and laughing."
a. Staff 1 stated that she did not want child 1 to wake up the other children who were sleeping.
3. Staff 1 indicated she gave child 1 several verbal prompts to be quite. Nevertheless, child 1 continued to laugh.
a. Staff 1 stated that in another attempt to quite child 1, "I pulled the cot toward me approximately 2 to 3 feet using the handle on the end of the cot."
b. Staff 1 stated that she did not see child 1 hit his head when she moved the cot as the cot was behind her when she moved it.
4. Child 1 stated, "One of my teachers pulled my cot up and slide it and I hit my head." Child 1 also stated, ....."made my body slide up and my head hit the top of the cot."
5. The parent of child 1 indicated that a scratch and bruise was visible when child 1 was picked up at approximately 4:45 pm on 06/10/2021.
a. The parent stated that child 1 indicated that he had hit his head on the front end of the cot during nap when staff 1 pulled the cot toward her.

Plan of Correction: *June 18, 2021 - Continue providing behavior guidance training with regular follow up inspections.
*June 18, 2021 - Behavior Guidance training was provided/reviewed during Staff In-Service. Teachers are required to complete online training as part of their initial hiring and receive one on one training from the School Director during onboarding process.

Complaint related: Yes
Description: Based on interviews and record review, the center failed to maintain a written record of children's minor injuries in which entries are made the day of occurrence.

Evidence:
1. The center failed to write an injury report, on the day of occurrence, for a scratch on the forehead of child 1.
a. This scratch was received while child 1 was in care on 06/10/2021.
2. Center staff 1 and administrative staff 2 confirmed that an injury report had not been written on the day of occurrence.
a. An injury report was completed on 06/11/2021.

Plan of Correction: *June 18, 2021 - Injury Report process was reviewed during Staff In-Service. Teachers receive training upon initial hire regarding the injury documentation process. Training ensures an understanding of proper completion of report and conveys the expectation of Leadership Team to receive injury reports the day they occur. Follow up training is provided by Leadership as needed.
*July 21, 2021 - During the monthly Staff meeting procedures on staff/child ratio, appropriate and inappropriate behavior and when/how to properly fill out injury report were reviewed.
