Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review and interviews.

A complaint inspection was initiated on 3/15/21 and concluded on 7/23/21. A complaint was received by the department regarding allegations in the areas of supervision and special care provisions and emergencies. The director was contacted by telephone to initiate the inspection. Interviews with staff and collaterals were conducted by telephone and documents related to the allegations were reviewed. Information gathered during the inspection determined non-compliances with applicable standards or law and violations were documented on the violation notice issued to the program.

Complaint related: No
Description: Based on interviews and a review of the center's policies, the center failed to ensure that the operational responsibilities of the licensee shall ensure that the center's services are maintained in compliance with the center's own policies and procedures that are required by these standards.

Evidence:
The center failed to follow their written policy for supervising outdoor play as demonstrated by the following incident:
1. The center's policy for playground safety and appropriate dress while on the playground states "Staff will ensure that children are wearing jackets, coats, mittens, gloves and/or hats, if needed."
2. On 12/21/20, the parent of child 1 (age 2 at the time of the incident) observed a picture on the center's web based application of his child outside on the playground with no coat on. The outside temperature that day was approximately 45 degrees.
3. Staff 1 admitted that she did not follow the center's playground safety policy on 12/21/20 by not helping child 1 put his coat back on after he had taken it off.
4. Staff 2 confirmed that staff 1 did not follow the center's policy on playground safety while outside with the children on 12/21/20.

Plan of Correction: The center responded with the following: Staff were retrained this same week on the importance of not allowing children to remove their coats provided by parents on inclement weather days. Management observes daily for compliance.

Complaint related: No
Description: Based on interviews, it was determined that the center failed to ensure that children under 10 years of age shall always be within actual sight and sound supervision of staff.

Evidence:
1. On 12/14/20, the parent of a child in the two year old classroom observed a video through the center's web based application of child 1 and child 2 taking their clothes off and running around the classroom.
2. Staff 3 stated on 12/14/20, she received a phone call from a parent that two children were taking their clothes off in the two year old classroom. Staff 3 stated she went into the classroom and helped the children put their clothes back on. Staff 3 stated that staff 1 was changing another child's diaper at the time of the incident and did not see the children remove their clothing. Staff 3 stated that when a staff person is changing diapers at the changing station, their back is turned away from the rest of the classroom and they are unable to have sight supervision of all the children in the room.
3. Staff 1 stated on 12/14/20, she was the only staff person in the two's classroom and was changing another child's diaper when child 1 and child 2 began taking their clothes off. Staff 1 stated that her back is to the rest of the classroom when she is standing at the diaper changing station and stated she was unable to see the other children in the room.

Plan of Correction: The center responded with the following: The week this occurred, staff were retrained by management, in addition to having daily hands on time with a Master Teacher from another school on classroom management, supervision and engagement. Staff were trained on how to manage diaper changing while solo in the classroom. Management provides ongoing observations to prevent reoccurrences.
