Discussion of out-of-state background checks and that this documentation shall be obtained prior to the start of these employees.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, interviews, and a virtual tour of the program.

A monitoring inspection was initiated and concluded on 07/22/2021. The Director was contacted by telephone and a virtual inspection was conducted. There were 120 children present, ranging from infants to school-age, with 18 staff supervising. The inspector reviewed compliance in the areas of administration; physical plant; staffing and supervision; programming; medication; special care and emergencies; and nutrition. A total of 5 children records, and 5 new staff records were reviewed.

Information gathered during the inspection determined that there were non-compliances with the applicable standards or law. These violations were documented on the Violation Notice issued to the program.

Standard #: 22VAC40-185-160-C
Description: Based on review, 2 of 5 staff files did not have current TB documentation on file.

Evidence -
1. On the date of inspection (07/22/2021), the most current TB documentation on file for Staff #1, and Staff #3 was dated from 2018. This documentation expired in 2020.
2. This review was confirmed by the Center Director.

Plan of Correction: Both Staff #1 and Staff #3 have received multiple reminder in order to obtain this documentation. Each shall be contacted again to obtain this updated documentation. Further administrative action may need to be taken by the center.

Standard #: 63.2(17)-1720.1-B-4
Description: Based on review, 2 of 5 staff files reviewed indicated that the Child Day Center (CDC) did not obtain a copy of the results of a criminal history record information check (CRC), a sex offender registry check (SOR), and a search of the child abuse and neglect registry (CPS) or equivalent registry from any state in which the individual has resided in the preceding five years.

Evidence -
1. On the date of inspection (07/23/2021), for Staff #2 (start date - 02/15/21) the following documentation was not available for review: an out-of-state SOR, and an out-of-state CRC from the State of Pennsylvania; and for Staff #4 (start date - 04/13/21) the following documentation was not available for review: an out-of-state CPS check, and an out-of-state SOR from the State of Maryland.
2. The center did not obtain this documentation prior to the start of employment for both Staff #2, and Staff #4.

Plan of Correction: These background checks shall be completed and sent for findings. Once this documentation is obtained it shall be reviewed by the Licensing Inspector. Going forward, this documentation for those applicable staff shall be obtained prior to their start date.
