Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documentation review, and interviews.

A complaint inspection was initiated on 08/06/2021 and concluded on 08/12/2021. The director was contacted by telephone and a virtual inspection was conducted. The inspector reviewed compliance in the areas of administration and supervision.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Description: Based on interviews and documentation, the center did not ensure behavioral guidance was constructive in nature, age and stage appropriate, and intended to redirect children to appropriate behavior and resolve conflicts.
Evidence:
1. On 8/6/2021, the center's representative revealed to the inspector that Teacher A told the center representative that they bit child A (age 2 years) because the child bit them.
2. On 8/06/2021, Teacher A revealed to the inspector that child A was throwing a tantrum during naptime. Teacher A picked child A off of the floor to place the child on their cot. Child A then bit Teacher A on the left arm. Teacher A stated that they began to tickle and talk to the child. Teacher A then tucked their lips inside of their mouth to cover their teeth and put their mouth on the child's arm, mimicking a bite. While pretending to bite the child, Teacher A stated, "How would you like it if I bit you?" Teacher A stated that they did not use any force while pretending to bite the child.
3. The parent of child A and the center representative examined child A and there was no bruising or marks observed on child A's body.
4. The behavior guidance strategy used by Teacher A was not constructive in nature, age and stage appropriate or intended to redirect children to appropriate behavior and resolve conflicts.

Plan of Correction: 1. The teacher was terminated immediately. 2. Talked with the parent whose child was involved and explained the situation and reassured then that the actions have been taken to avoid any future incidents. 3. Encourage staff to use behavioral management techniques such as redirecting the child in a positive way. 4. Have all staff take a training class on how to deal with challenging behavior in young children and how to incorporate appropriate techniques in the classroom. Persons Responsible: 1. [Director] 2.
