Technical Assistance:
Discussion of out-of-state requirements for new and existing staff prior to their start date with the CDC.

Discussion that the final regulation to amend Standards for Licensed Child Day Centers (22VAC40-185, now 8VAC20-780) to address federal health and safety requirements will become effective on October 13, 2021. Below is the link to view those standards with marked edits and changes.

Comments:
A monitoring inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, interviews, and a virtual tour of the program.

This inspection was initiated and concluded on 09/10/2021. The Early Childhood Education Director was contacted by telephone and a virtual inspection was conducted. There were 105 children present, ranging from infants to preschool age, with 29 staff supervising in a total of 11 separate classrooms. The inspector reviewed compliance in the areas of administration; physical plant; staffing and supervision; programming; medication; special care and emergencies; and nutrition. A total of 5 children records, and 8 new staff records were reviewed.

Information gathered during the inspection determined that there was a non-compliance with an applicable standard, code, and/or law. This violation was documented on the Violation Notice issued to the program.

Standard #: 63.2(17)-1720.1-B-4
Description: Based on review, 2 of 8 new staff files determined that the Child Day Center (CDC), did not obtain a copy of the results of a criminal history record information check (CRC), a sex offender registry check (SOR), and a search of the child abuse and neglect registry (CPS) or equivalent registry from any state in which the individual has resided in the preceding five years prior to reporting to the CDC.

Evidence -
1. On the date of inspection (09/10/2021), the following staff did not have the following out-of-state documentation available for review: Staff #1 (start date - 08/09/2021): CPS, SOR, and CRC from the State of Texas; and Staff #2 (start date - 08/09/2021): CPS, and SOR from the State of Colorado.
2. Both Staff #1, and Staff #2 started on site before these out-of-state findings were in house and on file at the CDC.

Plan of Correction: This error was discovered prior to the monitoring inspection. Background requests for both staff were sent to the applicable state agency on 09/01/2021. Once these documents have been obtained, they shall be shared and reviewed by the Licensing Inspector.
