63.2(17) License & Registration Procedures

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, interviews and a virtual tour of the program.

A renewal inspection was initiated on August 27, 2021 and concluded on September 1, 2021. The director was contacted by telephone and a virtual inspection was conducted. There were 51 children present, ranging in ages from five months to five years, with eight staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of five child records and seven staff records were reviewed.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22VAC40-185-280-B
Description: Based on observation and interview, the center did not ensure all hazardous substances such as cleaning materials, insecticides, and pesticides were kept in a locked place using a safe locking method that prevents access by children.

Evidence:

1. An unlocked gated area next to the pool contained multiple pool cleaning chemicals with warning labels to keep out of reach of children.
2. The administrator acknowledged the area was not locked.

Plan of Correction: Per the administrator: Children do not go in that area however the pool cleaning chemicals were removed and placed in a locked area.

Standard #: 22VAC40-191-60-C-2
Description: Based on review of staff records, the center did not obtain a completed original central registry check within 30 days of employment.

Evidence:

Staff #7, hired 01/25/2021, had a completed central registry check dated 04/26/2021 exceeding the requirement to obtain within 30 days of employment.

Plan of Correction: Per the administrator: Going forward, all background checks will be completed in the required time frames.

Standard #: 63.2(17)-1720.1-B-2
Description: Based on review of staff records, the center did not obtain national fingerprint background checks for individuals hired prior to January 22, 2018, by September 30, 2018.

Evidence:

Staff #5, hired 10/16/2017, had documentation of a national fingerprint check dated 11/06/2018, exceeding the required time frame to obtain by September 30, 2018.

Plan of Correction: Per the administration: Fingerprint background check are being obtained prior to hire.

Standard #: 63.2(17)-1720.1-B-4
Description: Based on review of staff records and interview, the center did not ensure individuals who lived outside the state of Virginia within the past five years obtained results of a sex offender registry check from any state in which the individual has resided in the preceding five years prior to employment.

Evidence:

The out of state sex offender registry check for staff #1 was dated 07/08/2021, exceeding staff #1's hire date of 07/06/2021.

Plan of Correction: Per the administration: The wrong background check was submitted. Once the correct forms were located the sex offender background check was completed.
