This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, and interviews.
A complaint inspection was initiated on 7/13/2021 and concluded on 8/13/2021. The director was contacted by telephone and an virtual inspection was conducted. The inspector reviewed compliance in the areas of administration, staffing and supervision, programming and staff qualifications and training.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Standard #: 22VAC40-185-40-E Complaint related: Yes Description: Based on interviews, the licensee did not ensure that staff followed the center's own policies and procedures regarding supervision, required by the standards, and the terms of the current license issued by the department.
Evidence:
1. Staff#1 stated that on the day of the incident, July 9, 2021, at approximately 9:15am, Staff#2 stepped out of the 4 year old classroom to get snacks, leaving Staff#1 with 10 children.
While the children were getting ready for snack, Staff#1 recalls seeing Child#1 (4 years old) playing with Legos, Staff#1 stated that after a few minutes they realized Child#1 was not in the classroom. Staff#1 opened the classroom door to look for the child in the hallway, as they were looking for the child, they noticed Staff#3 standing by the restrooms. Staff#1 asked Staff#3 if Child#1 was in the bathroom. Staff#2 stated that Child#1 was in the bathroom.
2. The center's missing or lost child policy states:
A) No child should ever be left alone.
B) It is all staff?s responsibility to know where the children in attendance are at all
times.
3. Staff#1 did not see Child#1 leave the classroom and they did not know the whereabouts of Child#1 for an unknown period of time. The child was left unsupervised and Staff#1 did not know where the child was at all times.Plan of Correction: As the FBCC CDC is committed to providing the highest possible quality care and early learning for each child enrolled, a document reviewing the center's own policies and procedures regarding supervision of children as required by the standards and the terms of the current license issued by the department will be prepared for each employee's review and acknowledgement.
Standard #: 22VAC40-185-350-E-4 Complaint related: Yes Description: Based on staff interviews and review of the center's written attendance, the center did not follow the 1:10 staff-to-children ratio requirement for four year old children.
Evidence:
During interviews two out of six staff interviewed stated that they routinely step out of their classrooms to use the restroom, leaving their classrooms over the required ratio for short periods of time. Two out of six staff interviewed stated that staff in the 4 year old classrooms would step out to use the restroom without first ensuring that additional staff arrives to maintain the required ratios.
1.On July 9, 2021, attendance records show that there were 13 children in the 4 year old classroom.
Based on interviews, Staff#4 was alone in their classroom and over the required ratio from approximately 8:25 to approximately 9:15am. The ratio of 1 staff member to 10 children was not maintained.
2.Staff#5 stated that on July 9 2021, they did not know how many children were in attendance prior to leaving the 4 year old classroom.
3. Staff#6 stated that even if they don't have enough staff to maintain ratios, they would just step out of the classroom if they need to use the restroom.
4. Staff#7 stated that they would only call for someone to step in the classroom to stay in ratio, if they know staff needs to be absent from the classroom for more than 5 minutes.
5. Staff#8 stated that staff would routinely step out of the classroom to use the restroom, sometime 3 times within an hour, leaving the classroom out of ratio several times a day.Plan of Correction: As the FBCC CDC is committed to providing the highest possible quality care and early learning for each child enrolled a document reviewing policies and procedures regarding maintaining adult-child ratios including when caregivers/teachers must leave the care and early learning setting as set forth in the current license issued by the department will be prepared for employees review and acknowledgement.
