63.2(17) License & Registration Procedures

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A unannounced non-mandated inspection was initiated on 02/09/2021 and concluded on 05/25/2021. A self-report about an incident that happened on 02/05/2021 was received by the department regarding care and protection. The director or in-charge person was contacted by telephone to conduct the investigation in conjunction with a local agency. The inspector emailed the director a list of documentation required to complete the investigation.

The evidence gathered during the investigation supported the allegation of non-compliance with standards or law and violations were issued. Any violations not related to the complaint but identified during the course of the investigation can be found on the violation notice.

Please complete the "plan of correction" and "date to be corrected" for each violation cited on the violation notice and returned it to me within 10 calendar days from today. You will need to specify how the deficient practice will be or has been corrected. Just writing the word "corrected" is not acceptable. Your plan of correction must contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s).

Violations:
Standard #: 22VAC40-185-40-E
Description: Based on documentation and interviews, the facility failed to follow their own policies and procedures for playground supervision.

Evidence:
1. On 02/18/2021, Staff #1 confirmed that he sent Child A outside on the playground beyond the outdoor classroom to collect materials and put them in a pile. Staff #1 stated that he got the child dressed for the cold, and watched the child through the window, and then Staff #1 became distracted.
2. The policy on supervision states, "Staff should always be aware and observant on the playground."
3. The Playground Supervision policy states, " The primary responsibility is to supervise the children and their activities."

Standard #: 22VAC40-185-340-A
Description: Based on interviews, staff failed to ensure the care and protection of a four-year-old child.

Evidence:
1. On 02/05/2021, a four-year-old child was out of sight and sound supervision of staff for approximately ten minutes.
2. The child was out on the playground by himself without supervision of a staff member.
3. The child opened the playground gate and walked toward a high traffic road (Hwy 29) in a heavily populated area. The child crossed the street to walk to his favorite spot to watch the traffic.
4. A stranger brought the child back to the child care facility.
5. Staff #4 confirmed a stranger returned the child to the facility.
6. Staff #1 stated that Child A was distraught when returned back to the center.

Standard #: 22VAC40-185-340-F
Description: Based on interviews, the center failed to ensure that children under 10 years of age were always within actual sight and sound supervision of staff.

Evidence:
1. On 02/05/2021, a four-year-old child was out of sight and sound supervision of staff for approximately ten minutes.
2. Staff #1 confirmed that he sent the child to the playground out past the outdoor classroom to collect materials and put them in a pile. Staff #1 confirmed that after Child A was on the playground Staff #1 became distracted.
3. Staff #2 confirmed that Staff #1 had sent the child out to the playground past the outdoor classroom.

Standard #: 63.2(17)-1720.1-A
Description: Based on review of staff records and interview, the center failed to obtain an out-of-state sex offender registry check in the required time frame.

Evidence:
1. Staff #4 (date of hire 06/19/2017) indicated on the sworn disclosure statement that she had resided in one other state in the previous 5 years.
2. The facility did not conduct a search of the sex offender registry for Staff #4 in the other state within the time frame required by 12/31/2020.
3. The administrator confirmed during the interview that the out-of-state sex offender registry check had not been completed by the required date.

Plan of Correction: The out of state sex offender registry check will be completed immediately. The out of state sex offender registry check was completed on 04/27/2021.
