63.2(17) License & Registration Procedures
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, interview, and a virtual tour of the program.
A renewal inspection was initiated on 09/14/2021 and concluded on 09/23/2021. The director was contacted by telephone and a virtual inspection was conducted. There were 40 children present with four staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, special care and emergencies and nutrition. A total of three children's records and five staff records were reviewed.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.
Standard #: 22VAC40-185-160-A Description: Based on record review, the licensee failed to ensure that each staff member had documentation of a negative tuberculosis (TB) screening or test no later than 21 days after employment.
1. There was no documentation of a completed TB test or screening for staff #1 and staff #3. The hire dates were documented as 3/26/2021 for staff #1 and 8/30/2021 for staff #3.
Plan of Correction: The administrative staff will obtain documentation for staff #1 and #3 TB tests/screenings. All staff in the future will have a TB test or screening that was completed within the last 30 days and prior to contact with children (effective 10/13/2021).
Standard #: 22VAC40-185-260-A Description: Based on interview and record review, the licensee failed to ensure that there was an annual fire inspection report.
1. The last report of a fire inspection that the site (Goodview Elementary School) had on record was dated 4/09/2019.
Plan of Correction: The administrative staff contacted the school's administration for an updated fire report. The site director will ensure reports are updated annually.
Standard #: 22VAC40-191-60-B Description: Based on record review, the licensee failed to ensure all staff had a completed Sworn Statement or Affirmation as a part of the background check prior to being employed.
1. The documented hire date for staff #2 was 9/11/2019. The date on the Sworn Statement form dated by the staff person was 9/19/2019.
2. The documented hire date for staff #3 was 8/30/2021. There was no Sworn Statement or Affirmation form available for review in the record for staff #3 that had been completed.
Plan of Correction: The administrative staff will have staff #3 complete a Sworn Statement form. The administrative staff will ensure that all staff have a completed Sworn Statement or Affirmation form completed prior to being employed.
Standard #: 63.2(17)-1720.1-B-2 Description: Based on record review, the licensee failed to ensure that staff submitted a fingerprint result as a part of the background check prior to hire.
1. There was no fingerprint results available for review in the record for staff #4. Staff #4 had a documented hire date of 9/13/2021.
Plan of Correction: The administrative staff will obtain results of the fingerprint record for staff #4. The administrative staff will ensure that there fingerprint results are received prior to hire for any additional staff hired.
Standard #: 63.2(17)-1720.1-B-4 Description: Based on record review, the licensee failed to ensure that a search of the child abuse and neglect registry or equivalent registry was completed for staff who had resided in another state within the last five years.
1. Staff #2 with a documented hire date of 9/11/2019 had indicated on the Sworn Statement completed 9/19/2019 that they had lived in another state within the last five years. There was no search of that state's central registry request made to that state as of the date of this inspection.
Plan of Correction: The administrative staff will send the search of the central registry for staff #2 and follow up if results are not received within 45 days.
