63.2 Child Abuse & Neglect

Technical Assistance:
The Virginia Department of Education (VDOE) assumed oversight of child care licensing and monitoring on July 1, 2021. All associated regulations and codes have transferred over from the Virginia Department of Social Services. The violations listed below reflect the new VDOE codes and standards.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, interviews and a tour of the program.

An investigation was conducted with multiple agencies after receiving a self reported incident by the Center. The investigation was initiated on 08/04/2021 and concluded on 09/21/2021. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, special services, medication administration and nutrition. The Center's video recordings, staff interviews, record review and ChesterBrook's own policies and procedures were reviewed. Any additional violations not related to the self-report but identified during the investigation can also be found on the Violation Notice.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22VAC40-185-40-E
Description: Based on video documentation a center staff did not follow the center?s own policies and procedures that are required by these standards.
Evidence:
1. Chesterbrook Academy?s Diaper Procedures state ?a staff member is to wash hands thoroughly before each diaper change, each child must be changed on the changing table, and the changing table must be wiped down after with antibacterial spray and staff are to wash hands after each diaper change with antibacterial soap? In bold letters the diapering procedures states that ?NEVER LEAVE A CHILD UNATTENDED ON A CHANGING TABLE?
2. On 7/28/2021 Staff#1 was observed in the center video documentation changing Child #2 directly on the floor at approximately 9:07 am (time stamp on video).
3. On 7/28/2021 Staff #1 was observed in the center video documentation changing Child #1 directly on the floor at approximately 11:57 am. Staff did not wash their hands after changing the diaper.
4. On 7/28/2021 Staff #1 was observed in the center video documentation changing Child #5?s diaper in the crib at approximately 1:47 pm.
5. On 8/2/2021 Staff #1 was observed in the center video documentation changing 3 children in succession. At no time did the staff wipe down the changing pad between diaper changes, wash their own hands or the children?s hands with antibacterial soap.
6. On 8/2/2021 Child #1 was having their diaper changed by Staff #1 at approximately 7:51 am. Staff #1 is observed in the center video leaving the child on the changing table and walking to the other side of the room to speak on the room phone and speak to someone in the hall.

Plan of Correction: ?School Admin will observe a skills assessment for each teacher demonstrating proper technique in both diaper changing procedures and handwashing procedures.
?Allergy List, Medications, Medication Authorization Forms, and Allergy Care Plans will be reviewed on a monthly basis, and updated as necessary. School Administration is responsible for keeping the allergy list current, informing the teachers of any changes, and posting the new allergy lists in the classrooms.
?School Admin team will conduct a random video review observation of each class weekly and will be documented on form. Feedback will be shared with teachers.

Standard #: 22VAC40-185-340-A
Description: Based on staff interview, staff were unable to offer immediate care to a child experiencing an allergic reaction.
Evidence:
1. On July 1, 2021 Child #1 was showing signs of an allergic reaction "with a rash, swelling of the lips and redness on the face (checks and neck) as well as scratching.?
2. Staff #2 had no knowledge of the location of the child?s emergency medication as it was not in the medication box.
3. Staff #2 had to call Staff #7 when the medication was not found in the medication box. Staff #7 failed to inform any staff at the center that the medication had been removed from the box before leaving the center.
4. Staff failed to follow the ?Food Allergy & Anaphylaxis Emergency Care Plan? submitted to the center. The allergy care plan was signed by the physician 6/8/2021. The allergy care plan states that ?For mild symptoms from more than one system area (nose, mouth, skin and gut) give Epinephrine? As described by Staff #2 the child had both skin and mouth reactions and should have been given the Epinephrine Pen.

Based on multiple staff statements, staff failed to ensure care when a child was served a known allergen as it was listed on the ?Food Allergy and Anaphylaxis Emergency Care Plan?
Evidence
On 8/23/2021 during morning snack, Child #1 was given a cupcake containing a known allergen (egg) that was listed in the child?s record. Three staff (staff #4-6) failed to verify that the cupcake was safe to be given to Child #1.

Based on video documentation, Staff #1 failed to ensure care when they were observed using unsanitary practices while supervising children.

Evidence:
1. On 7/28/2021 Staff #1 was observed at approximately 9:10 am using a towel to wipe the floor and then using the same towel to wipe Child #3?s face.
2. On 8/2/2021 Staff #1 was observed at approximately 8:49 am using the same Kleenex on Child #2 and Child #5.
3. On 8/2/2021 at approximately 2:56 pm feeding Child #3 and Child #5 with the same spoon.

Plan of Correction: ?A picture of each child with an allergy will be placed on the Allergy List for easy identification, and the allergy will also be highlighted on their Tadpoles profile.
?Allergy List, Medications, Medication Authorization Forms, and Allergy Care Plans will be reviewed on a monthly basis, and updated as necessary. School Administration is responsible for keeping the allergy list current, informing the teachers of any changes, and posting the new allergy lists in the classrooms.
?Purchase Classroom back packs and safety sacks to store emergency medications for students in that classroom.
?Allergy Response Drill will be introduced to staff, practiced Quarterly and documented in log.
?Create a written policy for birthdays/events regarding outside food. Communicate this policy to staff and families.
?Train all staff on new Allergy/Medication policy and procedures.
?A staff meeting will be held to train on a variety of topics including proper sanitary procedures.

Standard #: 22VAC40-185-350-E-1
Description: Based on video documentation, ratios for children were not maintained wherever children are in care. Ratios for children birth to the age of 16 months are 1:4. When children are regularly in mixed age groups, the staff to children ratio applicable to the youngest child in the group shall apply to the entire group.
Evidence:
Ratios on 8/02/2021 exceeded the 1:4 teacher to child ratio for children 0-15 months. Five children were present in the classroom with Staff #1 from approximately 8:31-9:00 am and then again from approximately 9:18-9:34 am. Date of birth of the youngest child present at these times was 14 months.

Plan of Correction: ?Re-train all staff on Tapoles/Attendance protocols.
?School Admin team will monitor Tapoles to make sure classes are in ratio.

Standard #: 22VAC40-185-370
Description: Based on video documentation, Staff failed to place infants on their back in a supine position.

Evidence:

In the video documentation provided, multiple children were placed in the crib on their stomachs throughout the three days by Staff.

Description: Based on video documentation, awake infants not playing on the floor or ground were not given a change in play space every 30 minutes.
Evidence:

On 8/2/2021 Child #2 was placed in the crib at approximately 10:15 am and did not fall asleep. The awake child remained in the crib until approximately 11:16 am.

Plan of Correction: ?Provide training for Infant staff on routines and activities for infants to include rotating activities for awake infants every 30 minutes by.

Standard #: 22VAC40-185-410-1
Description: Based on video documentation, Staff #1 used forbidden actions such as physical punishment, striking a child, roughly handling or shaking a child, restricting movement or forcing a child to assume an uncomfortable position.

Evidence:

7/28/2021
1. Staff #1 was seen on video documentation at approximately 9:13 am striking two children with soft balls.
2. Staff #1 was seen on video documentation at approximately 9:22 am roughly handling Child #5 as they put the child into the crib face down. The Child?s feet touch the mattress but their upper body bounces off the mattress.
3. Staff #1 was seen on video documentation at approximately 1:32-1:33 pm roughly shaking Child #3 multiple times while feeding a bottle.
4. Staff #1 was seen roughly handling Child #1 when they lift the child by one arm on the video at approximately1:59 pm.

8/2/2021
1. Staff #1 was seen on the video documentation at approximately 7:51 am roughly handling Child #1 by one leg and one arm.
2. Staff #1 was seen on the video documentation at approximately 8:32 am roughly shaking Child #3 multiple times while feeding a bottle.
3 Staff #1 was seen on video documentation at approximately 8:57 am roughly carrying Child #3 by one arm and causing the Child to hit Staff #1?s knee.
4. Staff #1 was seen on video documentation at approximately 11:43 am flipping and striking Child # 3 on their bottom.

8/3/2021
Staff #1 was seen on video documentation and by a parent tour participant at 1:25 pm pushing Child #2?s head down forcefully into the crib mattress 3 times and shoving the Child back into the crib.

Plan of Correction: ?School Admin team will conduct a random video review observation of each class weekly and will be documented on form. Feedback will be shared with teachers.
?On 9/7/21 all staff received training on Mandated Reporter procedures, Child Abuse and Neglect, Positive Guidance and Proper Handling of Children, and Forbidden Actions.
?All teachers will be re-trained on SIDS/Safe Sleep Practices for infants by 11/12/21.

Standard #: 22VAC40-185-500-A
Description: Based on video documentation, children?s hands were not washed with soap and running water after diapering.

Evidence:
Staff #1 does not wash children?s hands after diaper changes multiple times 7/28/2021-8/3/2021

Based on video documentation, a staff member did not wash their hands with soap and running water before and after a diaper change.

Evidence:
Based on video documentation, Staff #1 does not wash their hands following diaper changes multiple times.

Plan of Correction: ?Staff will be retrained on proper handwashing and diaper changing procedures for themselves and children, and will perform a skills demonstration for the school admin team.

Standard #: 22VAC40-185-500-B
Description: Based on video documentation, staff did not ensure the immediate safety of a child during diapering.

Evidence:
Based on the video on 8/2/2021 at approximately 7:51 am, Staff #1 was changing the diaper of Child #1 (14 month old) on the diaper changing table that is approximately 3 feet off the ground. The staff member was observed walking away from the occupied changing table to the opposite side of the classroom which is approximately 15 feet away to talk on the classroom phone.

Plan of Correction: ?Staff will be retrained on proper diaper procedures and will perform a skills demonstration for the school admin team.
