The Office of Child Care Health and Safety is in the process of creating a PDF version of the regulation that will be available on the Child Care VA website at https://www.doe.virginia.gov/cc/providers/index.html?pageID=10.

In efforts to minimize the impact of the hardships experienced by many child care providers across the state and in good faith of our partnership with you, there will be a 90-day implementation period, from 10/13/21 to 1/13/2022.

Comments:
A renewal inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, interviews, and use of a virtual platform.

This inspection was initiated and concluded on 11/05/2021. The Director was contacted and a virtual inspection was conducted. There were 44 children present, ranging from infant to school-age, with 10 staff supervising, within 5 classrooms. The inspector reviewed compliance in the areas of administration; physical plant; staffing and supervision; programming; medication; special care and emergencies; and nutrition. A total of 5 children records, and 5 new staff records were reviewed.

Information gathered during the inspection determined that there were a total of (2) non-compliances with an applicable standard, and code. These violations were documented on the Violation Notice issued to the program.

Violations:
Standard #: 22VAC40-185-160-C
Description: Based on review, 1 of 5 staff files indicated that is has been more than two years from the date of the most recent tuberculosis (TB) documentation on file.

Evidence -
1. On the date of inspection (11/05/2021), the current TB documentation on file for Staff #1 was dated - 10/17/2019.
2. This was confirmed on the date of inspection by the Center Director.

Plan of Correction: Staff #1 has scheduled an appointment to obtain this documentation.

Standard #: 63.2(17)-1720.1-B-4
Description: Based on interview and review, 1 of 5 staff files indicated that the Child Day Center (CDC) did not obtain a copy of the results of a criminal history record information check from any state in which the individual has resided in the preceding five years before reporting to the CDC.

Evidence -
1. On the date of inspection (11/05/2021), it was determined that Staff #1 lived outside of the Commonwealth of Virginia within the past 5 years.
2. While the CDC has both (for Staff #1) a Child Protective Services check and a Sex Offender Registry check from the State of Arizona, the center did not obtain a Criminal Record Check (CRC) from this same state.
3. The Director stated that the center was under the belief that Arizona was part of the National Fingerprint File (NFF) and emailed a list that she had relied on. This list showed states that participate with the NFF and those with the Interstate Identification Index (III). Upon further review, the State of Arizona is part of the III, and does not participate with the NFF.
4. The start date for Staff #1 was listed as - 10/24/2019.

Plan of Correction: A request for a CRC from the State of Arizona will be obtained. It will be reviewed with the Licensing Inspector (LI), and placed on file.
