Technical Assistance:
New requirements became effective on October 13, 2021. The facility has not yet [fully] complied with the following requirement: 22VAC40-185-40-K The center shall develop written procedures for abusive head trauma.
As of 9/1/21 all child care facilities that serve preschool-age children operating in a building built before 2015 are to be equipped with at least one carbon monoxide detector (? 22.1-289.058 to the Code of Virginia). As of the date of this inspection this facility equipped with a carbon monoxide detector.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review and interviews.

A monitoring inspection was initiated on 11/4/21 and concluded on 11/12/21. The director was contacted by telephone and a virtual inspection was conducted. There were 28 children present, ranging in ages from 2 to 10, with 8 staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of 3 child records and 3 staff records were reviewed.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22VAC40-185-70-A
Description: Based on record review and interview, the center failed to ensure new staff hired prior to 10/13/21 submitted all required documentation for the records.
Evidence:

1. Staff 1's date of hire was documented as 3/8/21 and start date was 7/1/21. The TB results are dated 8/27/21.
2. Staff 2's date of hire was documented as 7/8/21. The TB results are dated 8/27/21.
3. Documentation of a negative tuberculosis (TB) screening is required no later than 21 days after employment for staff hired prior to 10/13/21.

Plan of Correction: In the future the director will ensure the TB screenings or completed in the required timeframe for new staff.

Standard #: 63.2(17)-1720.1-B-4
Description: Based on record review and interview, the center failed to obtain a copy of the results of a criminal history record information from any state in which a new staff member has resided in the preceding five years prior to the first day of employment.

Evidence:

1. The sworn disclosure for staff 2 documents living in Mississippi in the last five years. The record documents the date of hire as 7/9/21. There is no documentation of a criminal history check being completed in Mississippi.
2. The director stated a criminal background check was not completed for Mississippi.

Plan of Correction: The director will complete a criminal background check for staff 2. In the future any staff member that an out-of-state criminal background check is required will be completed prior to employment.
