63.2(17) License & Registration Procedures

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, interviews, and a virtual tour of the program.

A monitoring inspection was initiated on 11/03/2021 and concluded on 11/08/2021. The program coordinator was contacted by telephone and a virtual inspection was conducted. There were 63 children present, ranging in ages from 5 years to 12 years, with 8 staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of 4 child records and 4 staff records were reviewed.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22VAC40-185-550-E
Description: Based on staff interview, the facility failed to maintain a record of the dates of the practice drills for one year. Evidence: management stated that the emergency drill log for the previous school year and summer session had been accidentally thrown out. There was no record of the evacuation drills or shelter in place drills prior to September 2021.

Plan of Correction: The emergency drill logs will be maintained for at least one year.

Standard #: 22VAC40-191-60-C-2
Description: Based on review of four staff files and staff interview, the provider failed to have documentation of a completed search of the central registry (CPS check) for each staff within 30 days of employment. Evidence: Staff 2 (date of hire 9/29/2020) and Staff 3 (date of hire 10/08/2021) did not have documentation of a search of the central registry check.

Plan of Correction: Center staff will contact the Central Registry office to check on background checks if they can not be located.

Standard #: 63.2(17)-1720.1-B-4
Description: Based on review of four staff files and staff interview, the facility failed to obtain the required out of state background checks when an applicant has lived in another state in the past five years. Evidence: Staff 3 (date of hire 10/8/2021) lived in another state in the past five years. There was no documentation of a search of the sex offender registry for that state prior to employment or a search of the central registry sent to that state within 30 days of hire.

Plan of Correction: The out of state sex offender check will be conducted as soon as possible and the out of state search of the central registry will be sent as soon as possible.
