The final regulation to amend Standards for Licensed Child Day Centers (22VAC40-185, now 8VAC20-780) to address federal health and safety requirements became effective October 13, 2021. The final regulation can be found at: https://www.doe.virginia.gov/cc/files/final-8vac20-780.pdf
Discussed with the new Director the requirements for: the timing of drills and pulling of alarms; the timing of tuberculosis (TB) tests; annual fire and health inspections; and the requirements for emergency contacts.

This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contact, documentation review, interview, and a virtual tour of the program.
A monitoring inspection was initiated on 11/17/21 and concluded on 11/29/21. The director was contacted by telephone and a virtual inspection was conducted. There were 10 children present, ranging in age from 18-months to four-years-old, with four staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies, and nutrition. A total of two child records and two staff records were reviewed. Information gathered during the inspection determined non-compliance with applicable standards or law and a violation was documented on the violation notice issued to the program.

Standard #: 22VAC40-185-240-D-5 Description: Based on review of documentation and interview with the Director, the center did not ensure that there was always at least one staff member on duty who had obtained daily health observation (DHO) training within the last three years. Evidence: The Director stated that the only staff member who was current in DHO training was the Assistant Director. The Assistant Director is shared with another location and therefore is not on site during all hours of operation. Plan of Correction: A full time Assistant Director who is current in DHO training is starting 12/6/21 and the Director will receive the training on 12/8/21. One of the two will always be on site until we are able to get more staff trained.
