22.1 Early Childhood Care and Education

Comments:
This inspection was conducted by licensing staff both on-site and using an alternate remote protocol, including telephone contacts, documents review, interviews and a tour of the program.

A renewal inspection was initiated on 12/13/21 and concluded on 12/14/21. The director was contacted by telephone to initiate the inspection. The inspector emailed the director a list of items required to complete the inspection. An on-site tour of the center was also conducted. There were 46 children present with 8 teachers and 2 administrative staff. Children were observed participating in morning montessori activities, eating lunch and playing on the playground. Handwashing and toileting procedures were also observed. A sample of 3 children's records and 4 staff records were reviewed. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.035-B-4
Description: Based on record review and interview, the center did not ensure that a copy of the results of a criminal history record information check is obtained from any state in which the individual has resided in the preceding five years.

Evidence:
1. Staff 1 has a hire date of 11/17/21. Staff 1 indicated on her sworn statement or affirmation that she has resided in the states of Alabama and California within the past five years. The results of a criminal history record check were not available for staff 1 from the state of Alabama or California.
2. The center administrator confirmed that the required background checks for staff 1 were not obtained from the states of Alabama and California.

Plan of Correction: The center responded with the following: The criminal history record checks for staff 1 will be requested from the states of Alabama and California and the results will be forwarded to the licensing inspector. Going forward, the center will ensure that all required out-of-state background searches are completed within the required timeframes.

Standard #: 8VAC20-780-280-B
Description: Based on observation and interview, the center did not ensure that hazardous substances such as cleaning materials shall be kept in a locked place using a safe locking method that prevents access by children.

Evidence:
1. There were numerous bottles of cleaning products, to include comet, clorox, window cleaner and disinfectant, in an unlocked cabinet above the sink in the Children's House 1 classroom. The cleaning products were accessible to the children in care.
2. The Head of School confirmed that the cleaning products were being stored in an unlocked cabinet.

Plan of Correction: The center responded with the following: A lock will be placed the cabinet used to store hazardous materials.

Standard #: 8VAC20-780-550-H
Description: Based on a review of emergency drill records and interview, the center did not ensure that a record of the dates of the practice drills is maintained for one year.

Evidence:
1. There is no documentation of an emergency practice drill for the months of September, October and November 2021 for the center.
2. The Head of School confirmed that the emergency practice drills for September, October and November 2021 were not documented.

Plan of Correction: The center responded with the following: Practice drills for September, October and November 2021 were conducted but not documented. Going forward, the center will ensure that all practice drills are documented as required by the standards.
