Technical Assistance:
Discussion for the need of the issuance of a corrected license due to a typo that left off the number "4" to the address of the Child Day Center.

Discussion of some of the new standards that went into effect on 10/13/2021. The Center Director was encouraged to download a digital copy from the departments website. It was also determined that the center complies with the new standard that requires buildings built prior to 2015 that serve preschool age children to have at least one carbon monoxide detector installed on-site.

Discussion of standard 8VAC20-780-530.A - At least one staff in each classroom or area where children are present shall be certified in both CPR and First Aid, within 90 days of October 13, 2021.

Discussion of the center's mask policy versus the recent Executive Order #2 signed by the Governor of the Commonwealth of Virginia.

Comments:
A monitoring inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, interviews, and a virtual tour of the program.

This inspection was initiated and concluded on 01/20/2022. The Director was contacted and a virtual inspection was conducted. There were 99 children present, within 10 classrooms, ranging from infant to preschool age, with a total of 17 classroom staff supervising. The inspector reviewed compliance in the areas of administration; physical plant; staffing and supervision; programming; medication; special care and emergencies; and nutrition. A total of 5 children records, and all 8 new staff records were reviewed.

Information gathered during the inspection determined that there were (6) six non-compliances with the applicable standards, code, and/or law. These violations were documented on the Violation Notice issued to the program.

Violations:
Standard #: 8VAC20-770-60-C-2
Description: Based on review and interview, 8 of 8 new staff files indicated that the licensed Child Day Center (CDC) does not have a central registry finding (CPS check) within 30 days of a staff person's employment.

Evidence -
1. On the date of inspection (01/20/2022), the following staff did not have a CPS check available for review: Staff #1 (start date: 11/30/2021), Staff #2 (start date: 08/02/2021), Staff #3 (start date: 11/07/2021), Staff #4 (start date: 09/13/2021), Staff #5 (start date: 08/12/2021), Staff #6 (start date: 11/19/2021), Staff #7 (start date: 11/11/2021), and Staff #8 (start date: 08/02/2021).
2. The Center Director stated (during an interview conducted on the date of inspection) that these requests of a search of the central registry were not sent out until this morning on 01/20/2022. This is outside the required timeframe of being sent within one week of each staff person's start date.

Plan of Correction: All 8 requests were sent this morning. Further employment will be denied for each employee until the findings are returned and has been reviewed by the Licensing Inspector. Moving forward all CPS request will be sent within the correct timeframe.

Standard #: 8VAC20-780-130-E
Description: Based on review, 1 of 5 children files indicated that the center did not obtain documentation of additional immunizations once every six months for a child under the age of two years.

Evidence -
1. On the date of inspection (01/20/2022), the most current immunization documentation on file for Child #1 was dated - 05/04/2021.
2. Based on information within their file, Child #1 was under the age of two years on the date of inspection.

Plan of Correction: An updated immunization page will be obtained and placed on file.

Standard #: 8VAC20-780-160-A
Description: Based on review, 3 of 8 new staff files indicated that TB documentation was not available for review for those staff hired prior to 10/13/2021.

Evidence -
1. The following staff did not have initial TB documentation available on the date of inspection (01/20/2022): Staff #2 (start date: 08/02/2021), Staff #5 (start date: 08/12/2021), and Staff #7 (start date: 09/28/2021).
2. This review was confirmed by the Center Director.

Plan of Correction: TB documentation will be obtained and filed in the applicable staff file.

Standard #: 8VAC20-780-160-A-1
Description: Based on review, 2 of 8 new staff files indicated that TB documentation was not available for review for those staff hired after to 10/13/2021.

Evidence -
1. The following staff did not have initial TB documentation available on the date of inspection (01/20/2022): Staff #1 (start date: 11/30/2021), and Staff #3 (start date: 11/07/2021).
2. This review was confirmed by the Center Director.

Plan of Correction: TB documentation will be obtained and filed in the applicable staff file.

Standard #: 8VAC20-780-160-A-2
Description: Based on review, 1 of 8 new staff files indicated that TB documentation was not completed within the last 30 calendar days of the date of employment and be signed by a physician, physician's designee, or an official of the local health department.

Evidence -
1. On the date of inspection (01/20/2022), the start date listed for Staff #8 was listed as 08/02/2021.
2. The TB documentation on file for Staff #8 was dated - 11/26/2020. This documentation was not within 30 days (prior) of Staff #8's start date.

Plan of Correction: TB documentation will be obtained and filed in the file of Staff #8.

Standard #: 8VAC20-780-420-E-3
Description: Based on interview, 1 of 5 children files indicated that the center did not request (at least annually) parent confirmation that the required information in the child's record is up to date.

Evidence -
1. The Center Director stated (during an interview conducted on the date of inspection - 01/20/2022) that a review by the parents of the required information for Child #3 was not conducted within the past year.
2. The start date for Child #3 was listed as 02/10/2020.

Plan of Correction: The Parent will review and document this review with a dated signature.
