22.1 Early Childhood Care and Education

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol with an in-person component that included telephone contacts, virtual documents review, interviews and a tour of the program with observations conducted at the center.
A monitoring inspection was initiated on 11/19/21 and concluded on 1/21/2022. The director was contacted by telephone and a virtual inspection was initiated to review records. The in-person components were completed on 11/19/21 and 12/13/21. The inspector reviewed compliance in the areas of administration, background checks, and staffing and supervision. A total of two staff records were reviewed.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.035-B-2
Description: Based on an interview with the program director, the facility failed to ensure that prior to employment or volunteering, all persons who work alone with children have completed fingerprint background checks.
Evidence:
1. There are no fingerprint background checks on file for adults #1 and 2 who worked alone with children on 10/26/21.

Plan of Correction: The program administrator reported that, now, all staff files are complete with all required paperwork before staff are employed

Standard #: 22.1-289.035-B-4
Description: Based on an interview with the program director and a review of documents, the facility failed to ensure that all persons who indicate on a sworn statement having lived outside Virginia in the last five years, and who work alone with children, have completed all required background checks prior to employment.
Evidence:
1. There was no out-of-state sex offender background check conducted for Staff #1 prior to the hire date of 9-13-21.
2. There was no out-of-state central registry background check sent for staff #1 as of the date of the inspection.

Plan of Correction: The program administrator reported that, now, all staff files are complete with all required paperwork before staff are employed.

Standard #: 8VAC20-770-60-B
Description: Based on an interview with the program director, the facility failed to ensure that prior to employment or volunteering, all persons who work alone with children have completed a sworn statement or affirmation.
Evidence:
1. There are no sworn statements on file for adults #1 and 2 who worked alone with children on 10/26/21.

Plan of Correction: The program administrator reported that, now, all staff files are complete with all required paperwork before staff are employed.

Standard #: 8VAC20-780-340-D
Description: Based on a review of staff files and an interview with the program director, the facility failed to ensure that there is a qualified program leader regularly present in each grouping of children.
Evidence:
1. Staff #1, who was the program leader in the preschool room 1 on October 26, 2021, does not meet the qualifications for the position. There was no documentation of any programmatic experience (a minimum of six months is required) or the education/training required for the job position. Staff #1 had been working in the position of program lead since the hire date 9/13/21.

Plan of Correction: The Program Administrator reported that the staff member is no longer employed with Grace A Child. We are only hiring qualified staff who have 6 months experience in a group care setting. 11/1/21

Standard #: 8VAC20-780-340-F
Description: Based on a review of recorded video footage, and interviews with staff and witnesses, on October 26, 2021, the facility failed to ensure that children under 10 years old are always within actual sight and sound supervision of staff.
Evidence:
1. At 9:17am, staff #1 left a classroom of 14 children, age 3, alone with adults #1 & 2, who were not staff members, for approximately four minutes. Adult #2 left the room after less than one minute, leaving adult #1 alone with 14 children.
2. Adults #1 & 2 stated that they were in the classroom when staff #1 left the room.

Plan of Correction: The program administrator reported that there has been a training on sight and sound supervision. We provided staff with walkie talkies so they can contact the front desk if they need to leave the room and so someone can come to relieve them. 11/1/21

Standard #: 8VAC20-780-350-B
Description: Based on interviews with staff and witnesses, and recorded video footage, the facility failed to maintain the required adult/child (one adult per 10 children) ratios on October 26, 2021.
Evidence:
1. At 9:02am there were 13 four and five year old children present in the Pre-K2 room. There was one staff member present. At 9:15am another child arrived. There were 14 children with one staff member until 9:31am when another staff person arrived.
2. At 9:12am there were 14 three-year-old children present with one staff member in the preschool 1 room until the teacher left the room at 9:17am.

Plan of Correction: The program administrator has redone schedules to make sure there are adequate staff to maintain ratio requirements.
