Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, interviews and a virtual tour of the program.

A monitoring inspection was conducted on January 27, 2022. The provider was contacted by telephone and a virtual inspection was conducted. There were 28 children present, ranging in ages from 3 to 5 years, and in the care of 6 staff. The inspector reviewed compliance in the areas of administration, physical plant, staff qualifications, staffing and supervision, programming, special services, medication, special care provisions and emergencies. A total of 3 children's records and 3 staff records were reviewed.

Information gathered during the inspection determined non-compliances with applicable standards or law and the violations were documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-770-40-D-6
Description: Based on review of staff records and discussion with the Associate Director, the center accepted a criminal history record report that was dated more than 90 days prior to the date of employment.

Evidence:
1. The record for Staff #3 contained a completed criminal history record dated 10/15/2021. Date of employment for 01/18/2022.
2. The Associate Director reported she was not aware a background check could not be more than 90 days old at the time of employment.

Plan of Correction: Staff #3 will obtain a new criminal history record check as soon as possible.

Standard #: 8VAC20-780-160-A-1
Description: Based on staff record review and verification from the Associate Director, one staff member had not obtained a tuberculosis (TB) screening at the time of employment and prior to coming into contact with children.

Evidence:
1. The record for Staff #2 did not contain documentation of a negative TB screening or test. Date of hire and date coming into contact with children was 01/18/2022.
2. The Associate Director stated that Staff #2 had not obtained a TB screening.

Plan of Correction: Staff #2 has made an appointment to obtain a TB screening. In the future, the Associate Director will ensure that any new staff member obtains a negative TB screening at the time of employment and before coming into contact with children.

Standard #: 8VAC20-780-160-A-2
Description: Based on staff record review and confirmation from the Associate Director, one staff member submitted a negative tuberculosis (TB) screening that had been completed more than 30 days before the date of employment.

Evidence:
1. The record for Staff #3 contained documentation of a negative TB screening dated 11/15/2021. Date of employment was 01/18/2022.
2. The Associate Director confirmed that the negative TB screening had been completed more than 30 before the staff member's date of hire.

Plan of Correction: Staff #3 will obtain an updated TB screening. In the future, the Associate Director will ensure that any new staff member submits a negative TB screening that had been completed within 30 days of the first date of employment.

Standard #: 8VAC20-780-260-B
Description: Based on record review and discussion with the Associate Director, the center failed to obtain an annual updated health inspection.

Evidence:
1. The date of the most current health inspection was dated 11/12/2020.
2. The Associate Director stated that she had not requested that an updated health inspection be completed.

Plan of Correction: The health department was called during the inspection and an updated inspection was requested.
