Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, interviews and a virtual tour of the program.

A monitoring inspection was conducted on January 28, 2022. The provider was contacted by telephone and a virtual inspection was conducted. There were 19 children present, ranging in ages from 4 to 6 years and in the care of 4 staff. The inspector reviewed compliance in the areas of administration, physical plant, staff qualifications, staffing and supervision, programming, special services, special care provisions and emergencies. A total of 3 children's records were reviewed. Three complete staff records and partial records for 5 staff were reviewed.

Information gathered during the inspection determined non-compliance with applicable standards or law and the violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.035-B-2
Description: Based on review of staff records and discussion with the director, one staff member?s record did not contain a completed criminal history record check before the date of employment.

Evidence:
1. The record for Staff #8 contained a criminal history record check dated 10/28/2021. Date of employment for Staff #8 was 09/25/2021.
2. The director confirmed that Staff #8 was employed before the finding of the criminal history record check was received.

Plan of Correction: Staff #8 will be attempting her 3rd finger print the week of Feb. 7, 2022. In the event that these prints return the same finding as the first, I will interview her, have her write a statement and keep all documentation

Standard #: 8VAC20-770-40-D-6
Description: Based on staff record review and verification from the director, the results of a criminal history record check for one staff member was dated more than 90 days prior to the date of employment.

Evidence:
1. The record for Staff #5 contained a criminal history record check dated 09/27/2018. The date of employment for Staff #5 was 05/04/2021.
2. The director verified that the criminal history record for Staff #5 was dated more than 90 prior to the date of employment.

Plan of Correction: She will be getting a new fingerprint made the week of Feb. 7th 2022, as the date on her current one is more than 90 days prior to her actual start date. This situation will be resolved upon the return of the background search and we expect this to return by March 10.

Standard #: 8VAC20-770-60-C-2
Description: Based on staff record review and confirmation from the director, the center did not obtain a search of the central registry by the end of the 30th day of employment for one staff member.

Evidence:
1. The record for Staff #4 contained the results of a search of the child abuse and neglect central registry dated 03/18/2020. Date of employment for Staff #4 was 08/21/2019.
2. The director confirmed the results of Staff #4 search of the central registry were not completed within 30 days of employment.

Plan of Correction: No action is needed at this time. Her review of records showed her central registry search was returned more than 90 days after her recorded hire date. I have learned to be very watchful of documenting position acceptance date independent of the date that the substitute actually begins service.
