22.1 Early Childhood Care and Education

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, interviews and a virtual tour of the program.

A monitoring inspection was initiated on February 8, 2022 and concluded on February 11, 2022. The director was contacted by telephone and a virtual inspection was conducted. There were 17 children present, ranging in ages from 4 months to age 4, with 6 staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of 2 child records and 2 staff records were reviewed.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-780-40-M
Description: Based on observation and record review the licensee did not ensure, the center shall maintain, in a way that is accessible to all staff who work with children, a current written list of all children's allergies, sensitivities, and dietary restrictions documented in the allergy plan. This list shall be dated and kept confidential in each room or area where children are present.

Evidence: There is one child, child #2 at the center with a diagnosed food allergy and this was not documented for the staff to view. This was confirmed by the center director.

Plan of Correction: Documentation of children with food allergies is Posted in the classrooms as well as the kitchen in a discrete location for staff to view.

Standard #: 8VAC20-780-245-J-3
Description: Based on observation and record review the licensee did not ensure that for any child for whom emergency medications (such as albuterol, glucagon, and epinephrine auto injector) have been prescribed shall always be in the care of a staff member or independent contractor who has obtained the medication administer training.

Evidence: Child #2, has an emergency medication (Auvi Q) at the center and was in care from approximately 9:05am until 12:00pm at the center and there was not a staff member available at the center with the required medication training.

Plan of Correction: Director will ensure that at least one staff member will be at the daycare when there are students with medical condition that require a staff with the certification to administer emergency medication. director has contracted a MAT trainer who will assist employees to receive their certification upon completion the MAT training.

Standard #: 8VAC20-780-340-D
Description: Based on review of 2 staff records and staff interviews, the licensee did not ensure that in each grouping of children at least one staff member who meets the qualifications of a program leader.

Evidence: During the inspection Staff #1 was observed working in the toddler room as the designated program lead teacher and Staff #2 was observed working in the preschool room as the designated program lead teacher. The records for Staff #1 and Staff #2 did not include documentation of meeting program leader qualifications.

Plan of Correction: Director has reviewed staff records and will ensure that the assigned lead teacher receives required training to meet qualification as a lead teacher. Staff will receive virtual training and some classroom training throughout the year. The director will locate some free virtual training.

Standard #: 8VAC20-780-570-E
Description: Based on observation and staff interviews, the licensee did not ensure that prepared infant formula shall be refrigerated, dated and labeled with the child's name.

Evidence: In the infant room refrigerator, there were 3 bottles labeled with a child's name but not dated.

Plan of Correction: Staff and parents have been made aware that formula shall be refrigerated, dated, and labeled with the child's name. Staff and parents are aware that the center will not accept bottles that do not have the child's name and date on the bottles. Bottles shall be refrigerated, dated and labeled with the child's name.

Standard #: 8VAC20-780-570-H
Description: Based on observation and staff interviews, the licensee did not ensure that prepared baby food not consumed during that feeding by an infant may be used by that same infant later in the same day, provided that the food is not served out of the baby jar and is dated and stored in the refrigerator; otherwise, it shall be discarded or returned to the parent at the end of the day. Formula or breast milk shall not remain unrefrigerated for more than two hours and may not be reheated.

Evidence: In the infant room refrigerator on 2-8-2022, there was 1 container of formula dated 2-7-2022 and the center staff indicated they keep the prepared formula in the refrigerator for up to 3 days and do not discard it or return it the parent.

Plan of Correction: Formula was returned to parent. Staff and parents have been notified that Formula and /or breast milk shall not remain unrefrigerated for more than two hours and it can not be reheated. Formula and or/ breast milk must be labeled with the correct date and will be returned to the parents at the end of the day.
