22.1 Early Childhood Care and Education

Comments:
This inspection was conducted by licensing staff both on-site and using an alternate remote protocol, including telephone contacts, documents review, interviews and a tour of the program.

A renewal inspection was initiated on 2/7/22 and concluded on 2/14/22. The center director was contacted by telephone to initiate the inspection and an on-site inspection was conducted on 2/14/22 from 10:45am until 1:00pm. At the time of the on-site inspection, there were 67 children in care with 10 staff present. A sample of 4 children's records and 4 staff records were reviewed. Children were observed engaging in learning activities, eating lunch and resting quietly during nap time. Restroom and handwashing procedures, lunch service and diapering procedures were also observed. First aid and emergency supplies, documentation of emergency practice drills, children's injury reports and required center postings were reviewed. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Description: Based on record review and interview, it was determined that the center did not ensure that a copy of the results of a criminal history record information check, a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry is obtained from any state in which the individual has resided in the preceding five years.

Evidence:
1. Staff 1 has a hire date of 1/4/22. Staff 1 indicated on her sworn statement or affirmation that she has resided in the state of Nevada within the past five years. The results of a criminal history record information check and a sex offender registry check were not available for staff 1 from the state of Nevada.
2. Staff 2 has a hire date of 1/24/22. Staff 2 indicated on her sworn statement or affirmation that she has resided in the states of California, Illinois and Maryland within the past five years. The results of a criminal history record check and a sex offender registry check were not available for staff 2 from the states of California or Illinois. The results of a sex offender registry check was not available for staff 2 for the state of Maryland.
3. Staff 3 has a hire date of 12/15/21. Staff 3 indicated on her sworn statement or affirmation that she has resided in the states of California, Colorado and North Carolina within the past five years. The results of a criminal history record check and a sex offender registry check were not available for staff 3 from the state of California. The results of a sex offender registry check and a search of the child abuse and neglect registry were not available for staff 3 from the states of Colorado and North Carolina.
4. The center director confirmed that the above required out-of-state background checks were not completed for staff 1, staff 2 or staff 3.

Plan of Correction: The center responded with the following: The out-of-state background checks for staff 1, staff 2, and staff 3 will be completed and the results will be forwarded to the licensing inspector once received. Going forward, the center will ensure that all required out-of-state background checks are completed within the required timeframes.
