22.1 Early Childhood Care and Education

Comments:
A complaint inspection was initiated on site on 10/28/2021 and concluded 11/15/2021. A complaint was received by the department regarding allegations in the area of ratio, meals, supervision, and building maintenance.
The evidence gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Complaint related: No
Description: Based on review of two staff records, the facility failed to have documentation of required background checks for each staff who have lived in another state in the past five years. Evidence: Staff B stated that she had resided in another state in the past five years. There was no documentation of sex offender registry search prior to hire or a search of the central registry within 30 days of hire.

Plan of Correction: Background checks will be sent in a timely manner.

Complaint related: No
Description: Based on review of two staff records, the facility failed to have a completed search of the central registry (CPS check) within 30 days of employment for each staff. Evidence: Staff B (date of hire 8/31/2021) did not have a search of the central registry on file.

Plan of Correction: Background checks will be sent in a timely manner.

Complaint related: No
Description: Based on staff interviews and documentation review, the facility failed to keep at the center a separate record for each child enrolled. Evidence: there was no record on site for one child present on 10/28/2021. The owner stated that the file had been sent home with the parent to complete and it had not been returned with the child.

Plan of Correction: Each child enrolled will have a completed file on site.

Description: Based on observation and the attendance record, the facility failed to have an accurate written record of daily attendance. Evidence: The attendance record did not include the first and last names of each child who was present on 10/28/2021.

Plan of Correction: An accurate attendance record will be kept daily.

Description: Based on review of two staff records, the facility failed to have documentation of orientation training for each staff prior to working with children. Evidence: there was no documentation to support that Staff A had orientation training.

Description: Based on observation, the facility did not maintain all areas and equipment in a clean, safe, and operable condition. Evidence: the light bulb in the bathroom was out and needed to be replaced, there were soiled clothes on the bathroom floor, there was a rocker toy over bare floor in the infant room, and the grass on the playground was too tall (between 7 and 12 inches) for the children to safely play.

Plan of Correction: Maintenance will be conducted as needed.

Description: Based on review of two staff files and staff interview, the facility failed to have a program leader in each grouping of children that meets the qualifications of a lead teacher. Evidence: Staff A did not have documentation that the qualifications to be a lead teacher are met.

Plan of Correction: Lead teacher will be present in each grouping of children.

Description: Based on observation and staff interview, the facility failed to maintain required staff to child ratio. Evidence:
1. Staff B is alone on site from 6:30 a.m. to approximately 9:00 a.m. with an average of 10 children ranging in age from 1 year to 12 years.
2. On 10/28/2021, the classes separated, and Staff A was alone with7 children, ranging in age from 1 year to 3 years.

Plan of Correction: Ratio will be maintained.

Complaint related: Yes
Description: Based on observation and staff interview, the facility failed to take the children outside for play when the weather permits. Evidence: the Staff A and Staff B stated they have not taken the children outside for play for over a month due to the grass being overgrown. The grass is over a foot in some areas.

Plan of Correction: The grass will be cut and children will be taken outside, weather pending.

Complaint related: Yes
Description: Based on observation and staff interview, the facility failed to provide meals as agreed. Evidence: Staff A and Staff B stated that the children were not fed breakfast on 10/28/2021. There was no trash to show breakfast had been served. The pantry, refrigerator, and freezer did not have adequate food to serve the children breakfast or lunch.

Plan of Correction: Meals will be provided as scheduled and by USDA food guidelines.
