22.1 Early Childhood Care and Education

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol with an in-person component that included telephone contacts, virtual documents review, interviews and a tour of the program with observations conducted at the center.

A complaint inspection was initiated on 12/13/21 and concluded on 2/28/22 . The in-person component was completed on 12/13/21 and 2/7/22. There were 78 children present, ranging in ages from four months to five years, with 13 staff supervising on 12/13/21. The inspector reviewed compliance in the areas of administration, staffing and supervision. A total of seven staff records were reviewed.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.035-B-2
Complaint related: No
Description: Based on a review of staff files, the facility failed to ensure that prior to employment or volunteering, all persons who work alone with children have completed fingerprint background checks.
Evidence:
1. There are no fingerprint background checks on file for staff #2 and 3. Hired 11/22/21 & 10/22/21.

Plan of Correction: The program director will ensure that each new staff receives a fingerprint appointment at the time of the interview. No staff will be hired until the fingerprint letter is received by the center.

Standard #: 22.1-289.035-B-4
Complaint related: No
Description: Based on staff interviews and a review of documents, the facility failed to ensure that all persons who indicate on a sworn statement having lived outside Virginia in the last five years, and who work alone with children, have completed all required background checks prior to employment.
Evidence:
1. There was no out-of-state sex offender background check conducted for Staff #6 prior to the hire date of 10-29-21.
2. There was no out-of-state central registry background check sent for staff #6 as of the date of the inspection.

Plan of Correction: The program director will ensure that all staff who report having lived outside Virginia in the last five years will complete all required out of state background checks. No staff will begin work without the required background checks.

Description: Based on a review of staff files, the facility failed to ensure that prior to employment or volunteering all persons who work alone with children have completed a sworn statement or affirmation.
Evidence:
1. There is no sworn statement on file for staff #3. Hired 10/22/21.

Plan of Correction: The program director reported that sworn statements are completed at the staff interview.

Description: Based on a review of staff files, the facility failed to ensure that each employee has a central registry finding within 30 days of employment or volunteering.
Evidence:
1. There are no central registry findings on file for staff #1 and 7. Hire dates 6/17/21 and 6/16/21.

Plan of Correction: The program director will ensure that new staff will complete the central registry forms at the interview. The forms will be mailed to the central registry on the first day of employment.

Description: Based on a review of staff files, the facility failed to ensure that all staff have a TB test or screening prior to coming into contact with children.
Evidence:
1. There are no TB test results on file for staff # 2,3,4,5,6 and 7. Hire dates 11/22/21, 10/22/21, 10/25/21, 10/27/21/ 10/29/21 and 6/16/21.

Plan of Correction: The program director will ensure that staff will complete a TB screening prior to coming into contact with children.

Description: Based on interviews with staff and witnesses and a review of video recording, the facility failed to ensure that aides are at least 16 years of age.
Evidence:
1. Staff #1, who was 15 years of age, was hired on 6/17/21 and worked as a classroom aide until 12/17/21. Staff #1 would not be 16 years of age until April 2022.

Plan of Correction: The program director reported that staff #1 no longer works at the center. Also, that no one under 16 years of age will be employed as a staff member, but may volunteer. Volunteers will not be left alone with children.

Complaint related: No
Description: Based on a review of recorded video and interviews with staff and witnesses, the facility failed to ensure care, protection and guidance of all children in care.
Evidence:
1. Staff #1 who was 15 years of age was hired on 6/17/21 and worked in classrooms as an aide until 12/17/21.
2. On 11/29/21, staff #1, a 15 year old, was left alone in the infant room with four infants in care from 5:12pm until parents arrived to pick up their children at 5:19, 5:26, 5:30 and 5:33pm.
3. On 12/1/21, staff #1, a 15 year old, was left alone in the infant room with three infants in care from 5:16pm until parents arrived to pick up their children at 5:23, 5:28 and 5:31pm.
4. On 12/3/21, staff #1, a 15 year old, was left alone in the infant room with three infants in care from 5:00pm until parents arrived to pick up their children at 5:15, 5:21, 5:37pm.
5. On 12/8/21, staff #1, a 15 year old, was left alone in the infant room with four infants in care from 5:09pm until parents arrived to pick up their children at 5:17, 5:20, 5:28 and 5:29pm.
6. On 12/10/21, staff #1, a 15 year old, was left alone in the infant room with four infants in care from 5:06pm until parents arrived to pick up their children at 5:23, 5:26, 5:27 and 5:41pm.
7. Staff #1 verified having regularly worked alone with the infants and that staff #8 had knowledge of staff #1?s age because staff #1 told staff #8 on numerous occasions.

Plan of Correction: The program director reported that staff #1 no longer works at the center. Also, that no one under 16 years of age will be employed as a staff member, but may volunteer. Volunteers will not be left alone with children.
